INSURANCE ON FILE A-2022-158-02 <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />1 • l • ZbZ3 <br />CLERK OF COUNCIL <br />DATE: CITY OF SANTA ANA <br />CONTRACTOR AGREEMENT FOR <br />ON -CALL ENGINEERING SERVICES WITH <br />PW ARDURRA GROUP, INC. <br />(�bu� k�ui��)6�)) <br />THIS GREEMENT is made and entered into on this 16"' day of August 2022 by and between <br />Ardurra Group, Inc., ("Contractor"), and the City of Santa Ana, a charter city and municipal <br />corporation organized and existing under the Constitution and laws of the State of California <br />o ("City"). <br />RECITALS <br />n_ <br />gn A. The City desires to retain a Contractor having special skill and knowledge in the field of <br />on -call water resources engineering services pursuant to RFP 22-002. <br />B. Contractor represents that Contractor is able and willing to provide such services to the <br />City. <br />C. On April 21, 2020, City Council approved agreements with Tetra Tech, Inc., Michael <br />Baker International, Inc., Psomas, Stantec Consulting Services, Inc., NV5, Inc., Huitt- <br />Zollars, Inc., Kimley-Hom and Associates, Inc., and TAIT & Associates, Inc. ("2020 <br />Agreements") to provide on -call engineering services for the Public Works Agency, Water <br />Resources Division. <br />D. On March 16, 2021, the City amended the 2020 Agreements to increase the funding amount <br />by $950,000 for the remainder of the term to allow these services to be utilized for <br />additional civil works projects included in the current and future fiscal years' Capital <br />Improvement Programs (CIPs). These agreements remain in full force and effect. <br />E. The City finds that new agreements under RFP 22-002 are required for additional services <br />for new civil works projects as the funding capacity has been reached under the 2020 <br />Agreements. <br />F. In undertaking the performance of this Agreement, Contractor represents that it is <br />knowledgeable in its field and that any services performed by Contractor under this <br />Agreement will be performed in compliance with such standards as may reasonably be <br />expected from a professional consulting firm in the field. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions hereinafter set forth, the parties agree as follows: <br />1. SCOPE OF SERVICES <br />Contractor shall perform during the term of this agreement, the services described in the <br />scope of work that was included in RFP No. 22-002 and that is attached as Exhibit A, and as <br />further delineated in Contractor's proposal, which is attached as Exhibit B and incorporated in <br />full. The Scope of Work under this Agreement is not intended to cover any civil works projects <br />
