I D. 1 <br />, <br />CLERK OF COU <br />A-2022-158-01 <br />c D DATE: NCIL _ CITY OF SANTA ANA <br />6 CONTRACTOR AGREEMENT FOR <br />c2 ON -CALL ENGINEERING SERVICES WITH <br />6,,'PU3A/Qo�VAWt(tPN)(AV)2 TETRA TECH, INC. <br />1 THIS AGREEMENT is made and entered into on this 10h day of August 2022 by and between <br />Tetra Tech, Inc. ("Contractor"), and the City of Santa Ana, a charter city and municipal corporation <br />organized and existing under the Constitution and laws of the State of California ("City"). <br />RECITALS <br />A. The City desires to retain a Contractor having special skill and knowledge in the field of <br />on -call water resources engineering services pursuant to REP 22-002. <br />B. Contractor represents that Contractor is able and willing to provide such services to <br />the City. <br />C. On April 21, 2020, City Council approved agreements with Tetra Tech, Inc., Michael <br />Baker International, Inc., Psomas, Stantec Consulting Services, Inc., NV5, Inc., Huitt- <br />Zollars, Inc., Kimley-Horn and Associates, Inc., and TAIT & Associates, Inc. ("2020 <br />Agreements") to provide on -call engineering services for the Public Works Agency, Water <br />Resources Division. <br />D. On March 16, 2021, the City amended the 2020 Agreements to increase the funding amount <br />by $950,000 for the remainder of the term to allow these services to be utilized for <br />additional civil works projects included in the current and future fiscal years' Capital <br />Improvement Programs (CIPs). These agreements remain in full force and effect. <br />E. The City finds that new agreements under REP 22-002 are required for additional services <br />for new civil works projects as the funding capacity has been reached under the 2020 <br />Agreements. <br />F. In undertaking the performance of this Agreement, Contractor represents that it is <br />knowledgeable in its field and that any services performed by Contractor under this <br />Agreement will be performed in compliance with such standards as may reasonably be <br />expected from a professional consulting firm in the field. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions hereinafter set forth, the parties agree as follows: <br />1. SCOPE OF SERVICES <br />Contractor shall perform during the term of this agreement, the services described in the <br />scope of work that was included in REP No. 22-002 and that is attached as Exhibit A, and as <br />further delineated in Contractor's proposal, which is attached as Exhibit B and incorporated in <br />full. The Scope of Work under this Agreement is not intended to cover any civil works projects <br />assigned to the 2020 Agreements. <br />1 <br />
