DocuSign Envelope ID: 6225CE08-C2AA-4269-9AF5-9311FF666B41 <br />charge an additional fee to examine an individual to determine if they are suitably Fit for <br />Confinement. <br />5.3 RELEASED PERSONS, PAROLEES, ESCAPEES AND PERSONS TRANSPORTED TO <br />AND FROM SAJ <br />[n no event shall Contractor be responsible for payment of any costs associated with any services <br />rendered to any individual when said individual is released from the custody of', or no longer <br />under thejurisdiction of, the SAJ including, but not limited to, releasees, parolees and escapees. <br />Furthermore, in no event shall CFMG be responsible for payment of costs associated with any <br />medical services rendered to a Covered Person when that Covered Person is injured outside tine <br />SAJ facility during transport to or from the SAJ. <br />ARTICLE VI <br />COST OF SERVICES NOT COVERED UNDER THIS AGREEMENT <br />6.0 SERVICES NOT LISTED, The Parties understand and agree there will be costs incurred for <br />healthcare related services as outlined in Articles 1,11 and Ill above. CFMG shall not be responsible <br />for any expenses not specifically covered tinder Articles I, 11 and HI of this Agreement. In the event <br />any of the health care services not covered by CFMG under Articles 1, 11 and III, or any services <br />not listed in this Agreement are required to be provided to a member of the Jail Population as a <br />result of the medical judgment of a physician or authorized personnel of CFMG, CFMG shall not <br />be responsible for arranging such services and the cost of such services shall be billed directly to <br />the City. <br />6.1 SERVICES BEYOND THE SCOPE OF THIS AGREEMENT. The Parties understand and <br />agree there are certain occurrences, at times, beyond the control and at other times, within the <br />control of the Parties which may result in health care expenses outside the scope or the regular <br />operation of a correctional facility and, therefore, outside the Scope of Services provided for in this <br />Agreement. While the Parties agree to act in good faith and endeavor to reduce the possibility of <br />such occurrences, in the unlikely event of an occurrence such as an Act of God, riot, explosion, <br />fire, food poisoning, epidemic illness outbreak or any other catastrophic event, or an event caused <br />by the actions or inactions of the City or SAJ employees, agents or contractors, which result in the <br />need for medical care for the Jail Population, staff, visitors, or contractors, CFMG shall not be <br />responsible for costs related to such catastrophic events and all such costs shall be borne by the <br />City, CFMG shall be responsible for medical costs antler this Agreement associated with such an <br />event only if such an event was caused solely by CFMG, its employees, agents or contractors. <br />ARTICLE VII <br />CITY'S DUTIES AND OBLIGATIONS <br />7.0 COMPLIANCE WITH HIPAA/STATE IIEALTH INFORMATION PRIVACY LAWS. The <br />City, SAJ, and its employees, agents and subcontractors shall comply with the Health 117SW'ance <br />Portability and Accountability Act of 1996 (hereinafter "HIPAA") and any State health information <br />privacy laws, to the extent they are applicable. The City/SAJ shall implement policies and/or <br />procedures in compliance with such laws. <br />7.1 COMPREHENSIVE MEDICAL/MENTAL IIEALTH CARE. Contractor shall identify to the <br />CityiSAJ staff those members of the Jail Population with medical or ibental health conditions which <br />Page 8 of 16 <br />
