Adopt a resolution approving Conditional Use Permit No. 2022-16 as conditioned. <br /> <br />EXECUTIVE SUMMARY <br /> <br />Beatriz Lozada, representing Maxi’s Pizzeria, on behalf of Max Martinez (Applicant), is <br />requesting approval of Conditional Use Permit (CUP) No. 2022-16 to allow the sale of <br />alcoholic beverages for on-premise consumption (Type 41- Beer and Wine) at a new <br />eating establishment located at 1017 South Fairview Street. Pursuant to Section 41-196 <br />of the Santa Ana Municipal Code (SAMC), establishments wishing to sell alcoholic <br />beverages for on-premise consumption requires approval of a CUP. Staff is <br />recommending approval of the applicant’s request because the site is located within a <br />commercial center intended for such uses, the site is located away from sensitive land <br />uses, and is in compliance with City standards. <br /> <br />DISCUSSION <br /> <br />Project Description <br /> <br />The Maxi’s Pizzeria will occupy a 2,662 square-foot restaurant building located on the <br />west side of Fairview between Fairview Street and McFadden Ave. The restaurant will <br />undergo interior tenant improvements resulting in modified kitchen, dining and <br />preparation areas. Once completed, the restaurant will accommodate up to 37 patrons <br />within the dining area. Site improvements will also be completed and include construction <br />of a trash enclosure, installation of landscaping, restriping and resurfacing of the parking <br />lot. Alcoholic beverages will be stored in a designated alcohol storage closet behind the <br />kitchen area. The restaurant will have an overall alcohol storage area of 19 square feet, <br />which is less than five percent of the gross floor area of the tenant space as required by <br />the Santa Ana Municipal Code (SAMC). <br /> <br /> <br /> <br />11/14/2022 <br />Planning Commission 1 – 1
