SECURITY <br />Licensee is solely responsible for arranging security for the Event and for payment of all costs therefore <br />directly to the security guard company selected. Security staff must be present throughout all weekend night <br />events, including parties, receptions, dances or other social functions in which alcohol is served and/or the <br />number of expected guests exceeds One Hundred (100). Owner reserves the right, exercisable in its sole <br />judgment, to require Licensee to increase the number of security personnel present at any Event, <br />regardless of the purpose, size or nature of the Event. <br />a. Security Company must be paid and submit proof 30 days prior to the event date, if the Security <br />Company is not paid in full the security deposit will be held until proof of payment has been <br />provided to the owner. <br />Any security firm utilized by Licensee is subject to approval by Owner. Owner will provide to Licensee a list <br />of security firms Owner has approved for use. At least fifteen (15) days prior to the Event, Owner must <br />receive from the Security Company a faxed or emailed copy of the signed contract between Licensee and such <br />Security Company, together with a Certificate of Insurance or other evidence that such Vendor has the <br />insurance required under Paragraph 5 of the Agreement. <br />The purpose of security personnel at the Event is to ensure the safety of the Event attendees and Owner's staff <br />and of the Center and owner's property. Licensee shall not use or permit such security personnel to assist the <br />Licensee in monitoring the Event for other purposes. The failure of the requisite security personnel to be <br />present at the Event is grounds for Owner to cancel the Event, in which event Owner may retain all deposits <br />and other sums paid by Licensee as a cancellation fee. <br />ADDITIONAL CHARGES AND FEES <br />Licensee agrees to pay the fees and charges set forth in the Agreement and in these Rules and Regulations. In <br />addition to such fees and charges, Licensee shall pay additional fines for infractions of the Rules and <br />Regulations in accordance with the following schedule: <br />False Fire Alarm $200.00 per occurrence <br />Items Left Behind, Following Event Conclusion $50.00 per day <br />Smoking Inside Facility $200.00 per occurrence <br />Confetti/Glitter/Rice etc. Used $100.00 <br />Wall/Floor Stains or holes $100.00 <br />Balloons Hanging or Loose in the Center $75.00 per occurrence <br />The foregoing fines are intended to compensate Owner for its administrative costs and expenses arising from <br />any such infractions and are not intended to constitute liquidated damages. Such fines are in addition to <br />Licensee's obligations to pay other fees and charges which Owner may impose under the Agreement and these <br />Rules and Regulations (including, without limitation, additional charges for time of Owner's staff, and <br />payment for all outside contractors used to repair or restore the Premises) and are in addition to Licensee's <br />obligations to indemnify Owner for all losses or damages Owner suffers arising from Licensee's use of the <br />Center. Additionally, the right of Owner to impose such fines is cumulative with, and shall not restrict the <br />exercise of, Owner's other rights and remedies under the agreement and the Rules and Regulations, including, <br />without limitation, Owner's right to terminate the Event and retain all deposits and monies paid by Licensee in <br />the Event of Licensee's violation of the Agreement or these Rules and Regulations. <br />10 <br />
