CITY OF SANTA ANA <br />CONSTRUCTION CONTRACT AGREEMENT <br />PROJECT NO.: 19-6951 (ATPSBIL-5063(193)) <br />SAFE ROUTES TO SCHOOL DAVIS ELEMENTARY ACCESS COMPLIANCE <br />The CITY uses a Quality Assurance Program (QAP) to ensure a material is produced to comply with the <br />Contract. You may examine the records and reports of tests the CITY performs if they are available at the <br />job site. Schedule Work to allow time for QAP in accordance with the Contract Documents. <br />10. PROMPT PAYMENT FROM THE AGENCY TO THE CONTRACTORS <br />The CITY shall make any progress payment within 30 days after receipt of an undisputed and properly <br />submitted payment request from the CONTRACTOR. If the CITY fails to pay promptly, the CITY shall <br />pay interest to the CONTRACTOR, which accrues at the rate of 10 percent per annum on the principal <br />amount of a money judgment remaining unsatisfied. Upon receipt of a payment request, the CITY shall <br />act in accordance with both of the following: <br />• Each payment request shall be reviewed by the CITY as soon as practicable after receipt for the <br />purpose of determining that it is a proper payment request. <br />• Any payment request determined not to be a proper payment request suitable for payment shall be <br />returned to the CONTRACTOR as soon as practicable, but not later than seven (7) days, after <br />receipt. A request returned pursuant to this paragraph shall be accompanied by a document setting <br />forth in writing the reasons why the payment request is not proper. <br />11. FORM FWHA-1273 REQUIRED CONTRACT PROVISIONS FEDERAL -AID <br />CONTRACTS <br />See Exhibit `B" of the Construction Contract. <br />12. FEMALE AND MINORITY GOALS <br />To comply with Section II, "Nondiscrimination," of "Required Contract Provisions Federal -Aid <br />Construction Contracts," the following are for female and minority utilization goals for Federal -aid <br />construction contracts and subcontracts that exceed $10,000: <br />• The nationwide goal for female utilization is 6.9 percent. <br />The goals for minority utilization [45 Fed Reg 65984 (10/3/1980)] are as follows: <br />MINORITY UTILIZATION GOALS <br />Economic <br />Area <br />(Percent) <br />Redding CA: <br />174 Non-SMSA (Standard Metropolitan Statistical Area) Counties: 6.8 <br />CA Lassen; CA Modoc; CA Plumas; CA Shasta; CA Siskiyou; CA Tehama <br />Eureka, CA <br />175 Non-SMSA Counties: 6.6 <br />CA Del Norte; CA Humboldt; CA Trinity <br />San Francisco -Oakland -San Jose, CA: <br />City Council 18 — 63 12/20/2022 <br />
