Public Works Agency <br />www.santa-ana.org/public-works <br />Item # 7 <br />City of Santa Ana <br />20 Civic Center Plaza, Santa Ana, CA 92701 <br /> Staff Report <br />January 17, 2023 <br />TOPIC: Exchange of Storm Drain Easement <br />AGENDA TITLE <br />Authorize Exchange of Storm Drain Easements within 1202 West Edinger Avenue <br />(Applicants and Owners: Mater Dei High School) <br />RECOMMENDED ACTION <br />Authorize the City Manager to execute quitclaim deeds relinquishing the City’s interest <br />in drainage easements at 1202 West Edinger Avenue, in exchange for replacement <br />storm drain easement. <br />DISCUSSION <br />On March 15, 2016, the City Council approved various actions to allow the Mater Dei <br />High School Parking Structure and School Expansion Project (Exhibit 1). <br />On June 5, 2018, the City Council adopted a Resolution to vacate portions of Baker <br />Street, Berkeley Street, and Occidental Street . <br />Mater Dei High School (Mater Dei) has now completed the construction of a three-story <br />parking structure at the southeast section of their campus. After construction of the <br />buildings and associated improvements within the development, the developer <br />discovered that portions of a storm drain easement conflict with the buildings. To <br />remove the conflict, the developer has requested the City quitclaim partial interest in the <br />easement (Exhibit 2), and in exchange, will grant a replacement easement (Exhibit 3). <br />Generally, storm drain easements provide for conveyance of storm water through <br />private properties to public facilities. In this case, easements will be granted to replace <br />the partial easement being quitclaimed. <br />Consistent with past practices for similar actions, staff examined whether the City would <br />require compensation for the value of the easement rights being quitclaimed. The <br />replacement easements cover a larger land area, and therefore no compensation is <br />needed. Staff recommends quitclaiming the existing storm drain easement in exchange <br />for receiving the replacement storm drain easement. <br /> <br />City Council 7 – 1 1/17/2023 <br />
