INSURANCE NOT REQUIRED N-2023-022 <br />WORK MAY PROCEED <br />CLERK OF COUNCIL <br />DATE - <br />CONSULTANT AGREEMENT <br />JAN 1 91013 CITY OF SANTA ANA <br />THIS AGREEMENT is made and entered into on this I Ith day of January, 2023 by and between <br />Andrew Linares ("Consultant"), and the City of Santa Ana, a charter city and municipal <br />g: WDW corporation organized and existing under the Constitution and laws of the State of California <br />076,'d_LPAS / ) ("City„). <br />RECITALS <br />A. The City desires to retain a Consultant having special skill and knowledge in the field of <br />data collection and analysis, program evaluation, public policy, and community <br />engagement. <br />B. Consultant represents that Consultant is able and willing to provide such services to the <br />City. <br />C. In undertaking the performance of this Agreement, Consultant represents that he is <br />knowledgeable in his field and that any services performed by Consultant under this <br />Agreement will be performed in compliance with such standards as may reasonably be <br />expected from a professional consulting firm in the field. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions hereinafter set forth, the parties agree as follows: <br />1. SCOPE OF SERVICES <br />a. Consultant shall perform during the term of this Agreement, the tasks and obligations <br />including all labor, materials, tools, equipment, and incidental customary work required <br />to fully and adequately provide administrative, constituent, and legislative support <br />services for Councilmember Phil Bacerra ("Councilmember") as provided in this <br />Agreement and in the Scope of Services, Exhibit A, attached hereto and incorporated <br />by reference. <br />b. At the direction of the Councilmember, Consultant shall perform a variety of <br />administrative, constituent, and legislative functions and tasks, including, but not <br />limited to, conducting complex administrative studies, researching and responding to <br />constituents' inquiries, drafting written communications involving strategy, policies, <br />and/or procedures, coordinating assigned project activities, and serving as a liaison, <br />where necessary. <br />c. As may be required for services at City Hall, the City may provide temporary office <br />space, and facility access — consistent with City procedures — should Consultant require <br />limited access to perform services required by the Councilmember. Consultant shall <br />maintain a business location separate from City, and Consultant understands that such <br />temporary office space and/or facility access is not required by the City but provided <br />to the Consultant on an as -needed basis. <br />
