require independent environmental review under CEQA; and WHEREAS, the Federal Emergency Management Agency ("FEMA") has issued a letter to the City of Approval Pending Adoption on September 23, 2022, and the updated HMP must be adopted by the local jurisdiction's governing body prior to FEMA issuing a Final Letter of Approval. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF S A N T A A N A, RESOLVES AS FOLLOWS: Section 1. The City Council finds that all of the facts set forth in the Recitals of this Resolution are true and correct. Section 2. The City Council has reviewed the Project and, based upon the whole record before it, in the exercise of its independent judgment and analysis, concurs that the adoption of the City of Santa Ana 2022 Hazard Mitigation Plan is exempt from consideration under the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Section 15061 (b)(3) because it can be seen with certainty that there is no possibility that the adoption of this Plan, in and of itself, may have a significant effect on the environment; and future projects described within the Plan may be subject to independent environmental review pursuant to CEQA, and therefore no further action is required under CEQA at this time. Section 3. If section, subsection, sentence, clause, phrase or word of this Resolution is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Resolution. The City Council hereby declares that it would have passed and adopted this Resolution, and each and all provisions hereof, irrespective of the fact that one or more provisions may be declared invalid. Section 4. This Resolution shall take effect immediately upon its adoption by the City Council, and the Clerk of the Council shall attest to and certify the vote adopting this Resolution.
