require independent environmental review under CEQA; and <br />WHEREAS, the Federal Emergency Management Agency ("FEMA") has issued a <br />letter to the City of Approval Pending Adoption on September 23, 2022, and the updated <br />HMP must be adopted by the local jurisdiction's governing body prior to FEMA issuing a <br />Final Letter of Approval. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF S A N T A A N A, <br />RESOLVES AS FOLLOWS: <br />Section 1. The City Council finds that all of the facts set forth in the Recitals of <br />this Resolution are true and correct. <br />Section 2. The City Council has reviewed the Project and, based upon the <br />whole record before it, in the exercise of its independent judgment and analysis, concurs <br />that the adoption of the City of Santa Ana 2022 Hazard Mitigation Plan is exempt from <br />consideration under the California Environmental Quality Act ("CEQA") pursuant to CEQA <br />Guidelines Section 15061 (b)(3) because it can be seen with certainty that there is no <br />possibility that the adoption of this Plan, in and of itself, may have a significant effect on <br />the environment; and future projects described within the Plan may be subject to <br />independent environmental review pursuant to CEQA, and therefore no further action is <br />required under CEQA at this time. <br />Section 3. If section, subsection, sentence, clause, phrase or word of this <br />Resolution is for any reason held to be invalid by a court of competent jurisdiction, such <br />decision shall not affect the validity of the remaining portions of this Resolution. The City <br />Council hereby declares that it would have passed and adopted this Resolution, and each <br />and all provisions hereof, irrespective of the fact that one or more provisions may be <br />declared invalid. <br />Section 4. This Resolution shall take effect immediately upon its adoption by the <br />City Council, and the Clerk of the Council shall attest to and certify the vote adopting this <br />Resolution. <br />ADOPTED this 17rh day of January 2023. <br />Resolution 2023-001 <br />Page 2 of 3 <br />
