<br />Resolution No. 2022-33 <br />Page 1 of 11 <br />RESOLUTION NO. 2022-33 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF <br />SANTA ANA AS FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines, and declares as follows: <br />A. Terry Womack, with Go2permitting, LLC, representing Chick-fil-A, Inc. <br />(Applicant) and Bristol Retail XV, LLC (Property Owner), is requesting <br />approval of a Conditional Use Permit (CUP) modification to facilitate the <br />construction of a second drive-through lane for an existing Chick-fil-A eating <br />establishment at 3601 South Bristol Street. <br />B. Santa Ana Municipal Code (“SAMC”) Sections 41-365.5(e) and 41- <br />377.5(a) require approval of a CUP for eating establishments with drive- <br />through window service. <br />C. On July 28, 2003, the City of Santa Ana Planning Commission held a <br />public hearing for the proposal of a new Krispy Kreme restaurant with <br />drive-through window service and after-hours operations on the subject <br />site. The Planning Commission unanimously recommended that the City <br />Council approve CUP-2003-15, CUP-2003-16, and Amendment <br />Application No. 2003-06, to allow for the new drive-through establishment, <br />after-hours operations, and a zone change to the subject property from a <br />Commercial Residential (CR) zone to a General Commercial (C-2) zone. <br />D. On August 4, 2003, the City Council unanimously approved CUP-2003-15, <br />CUP-2003-16, and Amendment Application No. 2003-06, and adopted an <br />Initial Study and Mitigated Negative Declaration (IS/MND), and Mitigation <br />Monitoring and Reporting Program (MMRP) for the subject site. <br />E. Pursuant to SAMC Section 41-638, the Planning Commission is <br />authorized to review and approve a modification to CUP No. 2003-15 for <br />this project as set forth by the Santa Ana Municipal Code. <br />F.
