Either the respondent or the complainant or both may appeal from a determination regarding responsibility, and from a <br />recipient's dismissal of a formal complaint or any allegations therein, on the following bases: <br />1. A procedural irregularity that affected the outcome of the matter; <br />2. New evidence that was not reasonably available at the time of the determination regarding responsibility or <br />dismissal, that could affect the outcome of the matter; and <br />3. The Title IX Coordinator, investigator(s), or hearing panel member(s) had a conflict of interest or bias for or against <br />complainants or respondents generally or the individual complainant or respondent that affected the outcome of the <br />matter. <br />Disagreement with the finding or sanctions is not, by itself, grounds for appeals. <br />Disciplinary proceedings conducted by the College are subjectto the Family Educational Records and Privacy Act (FERPA), <br />a federal law governing the privacy of student information. FERPA generally limits disclosure of student information <br />outside the College without the student's consent, but it does provide for release of student disciplinary information <br />without a student's consent in certain circumstances. Additional information about FERPA can be found on the College's <br />website at www.intercoast.edu. <br />CULTURAL DIVERSITY POLICY <br />InterCoast strives to achieve an inclusive environment and increasing diversity in our educational program with cultural <br />diversity as a core value. The school aspires to include the development of a culture where individuals move beyond mere <br />tolerance, but also embrace and celebrate the richness of debate and dialogue based upon cultural differences. The <br />school supports the development of a richly diverse student body as well as faculty and staff. The commitment to <br />diversity means the institution as a whole challenges itself and creates opportunities for a culturally diverse learning <br />environment. The school is and shall be supportive of cultural humility and that is incorporated into the educational <br />experience and practiced at the institution. <br />CELL PHONE USE POLICY <br />Cell phones should be turned off or muted during class sessions, as the ringing may interfere with class activities. Cell <br />phones should only be used in the classrooms In cases of emergency. Students are asked to leave the classroom to answer <br />emergency calls. <br />EATING / DRINKING / SMOKING POLICY <br />In order to maintain a clean, healthy, and professional learning environment, eating, drinking and smoking (including, <br />but not limitedto cigars, cigarettes, e-cigarettes, vapor cigarettes) are restricted to defined areas and smoking is never <br />allowed inside the building. <br />PARKING POLICY <br />InterCoast has reserved parking areas available for student parking. Free parking is available at all campus sites. Students <br />may notpark in undesignated student parking areas. InterCoast is not responsible for parking violations, tow away fees, <br />property theft, or property damage to vehicles. Vehicles should be kept locked at all times. Student parking decals, if <br />required, must be placed in student vehicles before parking at the school premises. <br />STUDENT RECORDS POLICY <br />The Family Educational Rights and Privacy Act (FERPA) (20 U.S.C. § 1232g; 34 CFR Part 99) is a Federal law that protects <br />the privacy of student education records. The law applies to all schools that receive funds under an applicable program <br />of the U.S. Department of Education. The Family Rights & Privacy Act prohibits an institution from releasing school <br />records or any other information about astudent to any third party without the student's written consent. InterCoast <br />protects the privacy of all students. Students are guaranteed right to access to their own files.
