Discuss Draft Ordinance Establishing a Police Oversight Commission and <br />Provide Direction to Staff <br />Department(s): City Manager Office <br />Recommended Action: Discuss a draft ordinance establishing a police oversight <br />commission and provide direction to staff. <br />MINUTES. Senior Management Analyst Daniel Soto provided a brief presentation. <br />Mayor Sarmiento requested the strongest powers allowable within existing laws <br />and requested the next step include the ordinance for discussion and possible <br />approval. <br />Councilmember Lopez requested inclusion of some items from the community - <br />advocated ordinance and provided thoughts regarding specific language in the <br />draft ordinance. <br />Councilmember Hernandez concurred with Mayor Sarmiento and Councilmember <br />Lopez's comments and expressed concerns with the independent nature of the <br />proposed Commission, access to records, and powers allowed to the Commission. <br />Councilmember Phan addressed various components of the model ordinance <br />provided by the community, the multiple steps required to fully implement this <br />process, and how complaints would be reviewed. <br />Councilmember Penaloza felt it was important to move forward with the current <br />model before them as other changes would require a charter amendment and <br />addressed components of the proposed ordinance. <br />Mayor Pro Tem Bacerra discussed the process involved with this item and believed <br />the ordinance and commission would continue to grow and evolve over time after <br />its initial approval and creation. He requested the Ad Hoc Committee reconvene to <br />continue reviewing this item going forward. <br />Councilmember Mendoza expressed support for the Police Oversight Commission, <br />by -ward membership, and professional guidance. <br />Mayor Sarmiento reiterated his initial comments about expansive powers subject to <br />existing laws and requested the ordinance return for Council consideration by <br />November 1, 2022.
