Planning and Building Agency <br />www.santa-ana.org/planning-and-building <br />Item # 34 <br />City of Santa Ana <br />20 Civic Center Plaza, Santa Ana, CA 92701 <br />Staff Report <br />July 18, 2023 <br />TOPIC: Ordinance Amendment No. 2023-03: 2nd Reading <br />AGENDA TITLE: <br />Second Reading of Ordinance Amendment No. 2023-03 to Exempt Certain Parcels <br />Identified by the City from the Requirements of Assembly Bill 2011 and Senate Bill 6 <br />Pursuant to California Government Code Sections 65912.114, 65912.124, and <br />65852.24 <br />RECOMMENDED ACTION <br />Conduct a second reading of Ordinance Amendment No. 2023-03 approving: 1) an <br />uncodified ordinance of the City Council of the City of Santa Ana exercising its retention <br />of local land use control pursuant to California Government Code sections 65912.114(i) <br />and 65912.124(i) and exempting certain parcels from California Government Code <br />sections 65912.114 and 65912.124; and 2) an uncodified ordinance of the City Council <br />of the City of Santa Ana exercising its retention of local land use control pursuant to <br />California Government Code Sections 65852.24(e) and exempting certain parcels from <br />California Government Code Sections 65852.24. <br />DISCUSSION <br />At its June 20, 2023 regular meeting, the City Council approved the first reading of an <br />uncodified ordinance to exempt certain parcels from streamlining provisions pursuant to <br />Government Code sections 65912.114 and 65912.124 (AB 2011), and also approved <br />the first reading of an uncodified ordinance to exempt certain parcels from streamlining <br />provisions pursuant to Government Code section 65852.24 (SB 6), by a vote of 6-1. <br />Concurrent with the approval of the first reading, the City Council also approved two <br />resolutions (Nos. 2023-037 and 2023-038) and two urgency ordinances (Nos. NS-3045 <br />and NS-3046) mirroring the exemptions. <br />The second reading of the ordinances includes correction of non -substantive <br />typographical errors found on pages 4 and 26 of Attachment 1 of the SB 6 ordinance <br />discovered after first reading. <br />ENVIRONMENTAL IMPACT <br />The City Council finds and determines that adoption of these ordinances are not subject <br />to the California Environmental Quality Act (CEQA).
