brs 6/5/23 <br />There shall be appointed two (2) additional members representing older <br />adults who shall be age fifty-five (55) or older. Notwithstanding anything to the contrary <br />in section 2-326: <br />Each of these two (2) additional members shall be nominated by one <br />(1) of the City's two (2) Senior Centers, respectively, in accordance with a policy <br />established by the Executive Director of the Parks, Recreation, and Community Services <br />Agency or their appointee, and appointed by a majority vote of the City Council. <br />The members appointed under this subsection (b) shall serve for a <br />term of two (2) years and until their respective successors are appointed or qualified, but <br />in no event shall any persons be eligible for reappointment who has served four (4) terms <br />of two (2) years each. <br />Vacancies in the membership positions created by this subsection <br />arising from whatever cause shall be filled in the same manner described in subsection <br />(b)(1). Upon a vacancy leaving an unexpired portion of the term, any appointment to fill <br />such a vacancy shall be for the unexpired portion of such term. <br />Section 3. The City Council finds and determines that this ordinance is not subject <br />to CEQA pursuant to Sections 15060(c)(2) and 15060(c)(3) of the State CEQA Guidelines <br />because it will not result in a direct or reasonably foreseeable indirect physical change in <br />the environment as there is no possibility it will have a significant effect on the <br />environment and it is not a "project," as defined in Section 15378 of the CEQA Guidelines. <br />Section 4. If any section, subsection, sentence, clause, phrase or portion of this <br />ordinance is for any reason held to be invalid or unconstitutional by the decision of any <br />court of competent jurisdiction, such decision shall not affect the validity of the remaining <br />portions of this ordinance. The City Council of the City of Santa Ana hereby declares that <br />it would have adopted this ordinance and each section, subsection, sentence, clause, <br />phrase or portion thereof irrespective of the fact that any one or more sections, <br />subsections, sentence, clauses, phrases, or portions be declared invalid or <br />unconstitutional. <br />Section 5. This ordinance shall become effective thirty (30) days after its adoption. <br />Section 6.
