5.11, Demotion. When an employee is demoted to a position in a lower classification, their <br />salary rate shall be fixed in the appropriate salary rate range for the lower classification in <br />accordance with the following provisions: <br />A. The salary rate shall be reduced by at least one (1) salary step (approximately five <br />percent (5%)). <br />B. The new salary rate must be within the appropriate salary rate range. <br />C. The new salary rate shall not be higher than the salary step to which the employee <br />would have been entitled had their service time in the higher classification been <br />spent in the lower classification. <br />D. If the salary rate recommended by the Department Head is lower than the maximum <br />step permissible under Section 5.11(C), such recommendation shall be considered <br />a reduction in pay in addition to the demotion and shall be handled in accordance <br />with the provisions for salary reductions in Section 5.9. <br />5.12 Reallocation of Salary Rate Ranges. Any employee who is employed in a classification <br />which is reallocated to a different salary rate range from that previously assigned shall be <br />retained in the same salary step in the new salary rate range as they had previously held in <br />the prior rate range and shall retain credit for length of service in such step towards <br />advancement to the next higher step. <br />5.13 Request for Classification Review. Any employee who, for a continuous period exceeding <br />six (6) mouths, believes they are regularly and consistently performing duties and/or <br />responsibilities not in conformance with their classification concept or, duties and/or <br />responsibilities of another classification, may request a classification review of their <br />position through their supervisor to the Department Head. The employee must submit their <br />request on a form specified by the Executive Director of Human Resources, outlining in <br />writing how they believe their current duties and/or responsibilities differ from their <br />classification concept. <br />A. The Department Head shall review the employee's submitted request and within <br />sixty (60) days shall make one of the following determinations: <br />Will support the employee's request. <br />a. If the Department Head supports the employee's request for a <br />classification review, they shall forward the request to the Executive <br />Director of Human Resources along with justification for support of <br />the employee's request. <br />The Department Head shall notify the employee that their request <br />has been submitted to the Executive Director of Human Resources. <br />Will not support the employee's request. <br />CONFIDENTIAL ASSOCIATION OF SANTA ANA (CASA) MOU: JULY 1, 2022 THROUGH JUNE 30, 2025 <br />Page 14 <br />
