employee's presence is required to handle funeral arrangements and/or <br />matters of estate. <br />B. Effective January 1, 2023, employees shall be granted up to five (5) days of leave <br />for the death of a member of the employee's immediate family, as specified in <br />Section 11.2(A). Three (3) of the days will be paid bereavement leave and the <br />remaining two (2) days of leave may be unpaid, except that an employee may use <br />accrued vacation, sick leave, or compensatory time. <br />C. Whenever an employee is required to travel one way more than five hundred (500) <br />miles to attend to the death of a member of the employee's immediate family, an <br />employee may use up to sixteen (16) hours of additional leave charged to their <br />Personal Necessity Leave balance when authorized by the Department Head. <br />11.3 Military Leave. <br />A. Proof of Orders and Reinstatements. An employee shall be granted military leave <br />if they furnish the Executive Director of Human Resources satisfactory proof of <br />their order to report for duty. Upon return and upon showing of proof of actual <br />service pursuant to such orders, they shall be reinstated as provided in Section 9- <br />143 of the Civil Service Rules and Regulations of the City of Santa Ana. <br />B. Temporary. Members of the reserve forces of the United States, or the National <br />Guard, granted temporary leave when ordered to duty, in accordance with the <br />Military and Veterans Code, shall be granted leave with pay not to exceed thirty <br />(30) calendar days in each calendar year after one (1) year of service with the City <br />upon presenting satisfactory proof of orders to and from such temporary active <br />duties. <br />11.4 Jury and Witness Leave. When an on -duty employee is called to serve as a juror or non- <br />party witness in any court action, they shall be allowed to leave for the time actually <br />required for such service without loss of pay. Each on -duty employee called for such <br />service shall present to their Department Head for examination the subpoena calling them <br />to such service and shall pay into the City Treasury the fees collected for such service, with <br />the exception of reimbursement for transportation expenses, if any. <br />If an employee is called to serve on jury duty during a normal Friday off, or a Saturday, or <br />Sunday, or on a City holiday, then the jury duty shall be considered the same as having <br />occurred during the employee's day off work. <br />11.5 Examination Leave. Employees participating in examinations conducted during their <br />normal working hours for positions in the competitive service of the City of Santa Ana <br />shall be granted leave with pay for the time actually required without loss of any accrued <br />vacation time off benefits. <br />11.6 Unauthorized Absence. Unauthorized absence from duty for any duration of time maybe <br />considered cause for dismissal.
