TRACTION POWER <br />SUBSTATION EASEMENT FOR VALUABLE <br />CONSIDERATION, receipt and sufficiency of which is hereby acknowledged, the <br />CITY OF SANTA ANA, a charter city and municipal corporadon organized and existing under <br />the Constitution and laws of the State of California, ("Grantor") hereby grants to the ORANGE COUNTY <br />TRANSPORTATION AUTHORITY, A Public Entity ("Grantee"), an exclusive traction <br />power substation easement (TPSSE) for the purpose of constructing, maintaining, repairing, <br />and adjusting, as applicable, above ground and underground facilities, and their <br />appurtenant fixtures and equipment, including but not limited to utility and communication facilities, <br />as required, in, under and across that certain real property situated in the City <br />of Santa Ana, County of Orange State of California, which is described in Exhibit "A and depicted <br />on Exhibit "B", both of which are attached hereto and made a part hereof. Rights and <br />Limitations of Use and Occupancy of TPSSE: OCTA shall <br />provide the owner(s) and occupant(s) of the property subject to this TPSSE a minimum of <br />thirty (30)-days written notice as to when the Construction Period will commence. During <br />the <br />Construction Period, OCTA may place a temporary fence around the TPSSE area. The <br />emergency <br />driveway/gated area in the NE area will not be accessible during the Construction Period <br />Access to <br />the TPSSE area shall be frorn public right of way. Driveway access <br />will be maintained at all times. The following <br />improvements within the TPSSE area will be removed as needed by OCTA to allow <br />for construction activities. All improvements so removed shall be included in the compensation paid <br />by OCTA for this TPSSE. o Pavement <br />within limits of TPSSE 0 6 <br />parking stalls (permanently) The following <br />improvements within the TPSSE area will be protected in place: o Adjacent <br />retaining wall o Adjacent <br />fencing 1201539.1 <br />City Council 7 –49 6/1/2021
