Local Guidelines for hnplennenting the <br />California IImdron ae [al Quality Act (2023) NEGATIVE DECLARATION <br />Negative Declaration, or FIR shall be prepared for that project unless the Lead Agency determines, <br />on the basis of substantial evidence in the light of the whole record, one or more of the following: <br />(a) Substantial changes are proposed in the project which will require major revisions of the <br />previous EIR, Negative Declaration, or Mitigated Negative Declaration due to the <br />involvement of new significant environmental effects or a substantial increase in the <br />severity of previously identified significant effects; or <br />(b) Substantial changes occur with respect to the circumstances under which the project is <br />undertaken which will require major revisions of the previous EIR, Negative Declaration, <br />or Mitigated Negative Declaration due to the involvement of new significant environmental <br />effects or a substantial increase in the severity of previously identified significant effects; <br />or <br />(c) New information of substantial importance which was not known and could not have been <br />known with the exercise of reasonable diligence at the time the previous EIR was certified <br />or the Negative Declaration was adopted which shows any of the following: <br />(1) The project will have one or more significant effects not discussed in the previous <br />EIR or Negative Declaration; <br />(2) Significant effects previously examined will be substantially more severe than <br />shown in the previous EIR; <br />(3) Mitigation measure(s) or alternative(s) previously found not to be feasible would <br />in fact be feasible and would substantially reduce one or more significant effects of <br />the project, but the project proponents declined to adopt the mitigation measure(s) <br />or alternative(s); or <br />(4) Mitigation measure(s) or alternative(s) which are considerably different from those <br />analyzed in the previous EIR would substantially reduce one or more significant <br />effects on the environment, but the project proponents decline to adopt the <br />mitigation measure(s) or alternative(s). <br />The City, as Lead Agency, would then determine whether a Subsequent EIR, Supplemental <br />EIR, Subsequent Negative Declaration, Subsequent Mitigated Negative Declaration, or Addendum <br />would be applicable. Subsequent Negative Declarations and Mitigated Negative Declarations <br />must be given the same notice and public review period as other Negative Declarations. The <br />Subsequent Negative Declaration shall state where the previous document is available and can be <br />reviewed. <br />(Reference: State CEQA Guidelines, § 15162.) <br />6.23 PRIVATE PROJECT COSTS. <br />For private projects, the person or entity proposing to carry out the project shall bear all <br />costs incurred by the City in preparing the Initial Study and in preparing and filing the Negative <br />Declaration or Mitigated Negative Declaration and Notice of Determination. <br />2023 City of Santa Ana Local Guidelines 6-18 ®Best Best & Krieger LLP <br />
