Public Works Agency <br />www.santa-ana.org/public-works <br />Item # 36 <br />City of Santa Ana <br />20 Civic Center Plaza, Santa Ana, CA 92701 <br />Staff Report <br />June 6, 2023 <br />TOPIC: Agreement with Floral Park Neighborhood Association for Fence on Broadway <br />AGENDA TITLE <br />Approve a License Agreement with the Floral Park Neighborhood Association for Use of <br />Broadway Right-of-Way for a Fence (Non-General Fund) <br />RECOMMENDED ACTION <br />Authorize the City Manager to execute a license agreement with the Floral Park <br />Neighborhood Association, a 501(c)3 nonprofit community organization, for use of <br />public right-of-way on Broadway from Santa Clara Avenue to the I-5 exit, subject to non- <br />substantive changes approved by the City Manager and the City Attorney. <br />DISCUSSION <br />The southbound exit of Interstate 5 (I-5) for Broadway and Main Street experiences <br />heavy usage and is located next to the Floral Park Neighborhood at the intersection of <br />Santa Clara Avenue and Broadway (Exhibit 1). In order to prevent litter and debris from <br />the freeway exit from entering the neighborhood, as well as to improve security and <br />aesthetics, the Floral Park Neighborhood Association (FPNA), a 501(c)3 nonprofit <br />community organization, is seeking permission to install a decorative wrought iron fence <br />within the public right-of-way. The proposed fence, which will be approximately five feet <br />tall, will be installed alongside the existing tree line and designed to harmonize with the <br />appearance of an adjacent private property fence (Exhibit 2). <br />The cost of the fence improvements will be paid for and maintained by the FPNA. To <br />document the FPNA right to use, maintain, and repair its fence, to identify insurance <br />requirements, and to prescribe terms of indemnification of the City by the FPNA, the <br />City and FPNA must enter into a License Agreement (Exhibit 3). <br />The Public Works Agency recommends approving the proposed license agreement, as <br />the proposed improvements will enhance the quality of life for the community. Moreover, <br />these improvements will not hinder existing drainage, pedestrian access, or any other <br />beneficial public uses of the space. <br />FISCAL IMPACT <br />There is no fiscal impact associated with this action.
