Planning and Building Agency <br />www.santa-ana.org/planning-and-building <br />Item # 28 <br />City of Santa Ana <br />20 Civic Center Plaza, Santa Ana, CA 92701 <br /> Staff Report <br />May 16, 2023 <br />TOPIC: Resolutions to Exempt Parcels from AB 2011 and SB 6 <br />AGENDA TITLE <br />Resolutions of the City of Santa Ana City Council Exempting all Eligible Properties in <br />the City of Santa Ana from the Requirements of Assembly Bill 2011 and Senate Bill 6 <br />Pursuant to California Government Code Sections 65912.114, 65912.124, and <br />65852.24 <br />RECOMMENDED ACTIONS <br />1)Adopt a resolution exempting all eligible properties in the City of Santa Ana from <br />the requirements of Assembly Bill 2011 and Senate Bill 6 pursuant to California <br />Government Code sections 65912.114 and 65912.124. <br />2)Adopt a resolution exempting all eligible properties in the City of Santa Ana from <br />the requirements of Assembly Bill 2011 and Senate Bill 6 pursuant to California <br />Government Code Section 65852.24. <br />EXECUTIVE SUMMARY <br />Over the last five years, numerous housing bills have been signed into law to address <br />the State's housing crisis. In general, changes to State law have attempted to solve the <br />housing crisis through limiting local land use controls to allow development proposals to <br />circumvent community review and comment, compliance with local land use plans, and <br />streamlining or exemption from the California Environmental Quality Act (CEQA). Cities <br />like Santa Ana that routinely exceed their Regional Housing Needs Allocation (RHNA) <br />for housing unit development are often not exempt from these laws. <br />Assembly Bill 2011 (AB 2011) and Senate Bill 6 (SB 6), which take effect July 1, 2023, <br />are two bills that will further restrict local land use controls and allow residential <br />development on parcels where commercial uses are the primary use. However, both <br />bills include provisions that allow local agencies to exempt parcels of land from these <br />types of streamlined approval processes provided certain written findings can be made. <br />Pursuant to California Government Code sections 65912.114(i), 65912.124(i), and <br />65852.24(e), the City of Santa Ana, based on the findings written in the resolutions <br />(Exhibit 1 and Exhibit 2), exempts eligible parcels from the streamlined approval <br />process provided by Government Code sections 65912.114, 65912.124, and 65852.24.
