B. A subpoenaed employee scheduled to appear in court on City business during off - <br />duty time may be placed on on -call status by the Police Chief or their authorized <br />representative if the employee can respond to the court, if called, within sixty (60) <br />minutes of the employee's notification. In the event such off -duty employee is on <br />on -call status during any court session and is not required to appear in court, such <br />employees shall be compensated two (2) hours at straight time, for each court <br />session. Such employee may elect, in lieu of paid time, to earn two (2) hours of <br />comp time off for standby time and not appearing in court, with the approval of the <br />Police Chief. <br />C. Employees assigned to the 3/12.5-7/12.5, or 3/12-4/12 Work Schedule who appear <br />in court during their regularly scheduled workweek, and who, as a result, do not <br />receive adequate rest (because of the hours of the day they work), will be allowed <br />to flex their scheduled shift start time up to four (4) hours, with the approval of the <br />employee's immediate supervisor and watch commander, or immediate supervisor <br />and section commander. Alternatively, the employee may be allowed to use up to <br />four (4) hours from their "Comp Time Banks" at the beginning of their scheduled <br />shift to ensure adequate rest. <br />An employee whose work shift ends or starts within thirty (30) minutes of <br />a mandatory court appearance shall be compensated for those thirty (30) <br />minutes at an overtime rate. <br />2. Employees assigned to a Watch 3 (6:00 p.m. to 6:30 a.m.) who are required <br />to appear in court following the end of their shift will have the option of <br />remaining on duty or ending their shift. Employees that continue active <br />duty will be compensated at time and one-half while on duty. Employees <br />that end their shift will be unpaid prior to their court appearance. <br />D. Employees who are on call for court during off -duty time, and who are called to <br />testify, will be paid at the overtime rate of time and a half of their regular hourly <br />rate, to include actual travel time from their home to court and back, or until their <br />regularly scheduled shift begins. Travel time will be limited to a maximum of one <br />(1) hour each way. Only that period of time devoted to work will be compensated. <br />Time spent on personal pursuits or other non -work related activity will not be <br />compensated. <br />E. Those employees who have advance notice of their required appearance in court, <br />have arranged an appearance time with the District Attorney's Office, or who <br />otherwise have advance notice of mandatory court appearances, will not be <br />compensated for travel time in any manner. <br />F. Employees who appear in court during off -duty hours may elect to start their normal <br />work shift early as specified herein. <br />G. A subpoenaed employee scheduled to appear in court on City business during off - <br />duty time and placed on -call by the Police Chief or their authorized representative <br />will be compensated two (2) hours at straight time if they are not advised of the <br />31 <br />
