of this section only, a "day" shall be defined as the number of hours of work that <br />an employee is required to work according to their specific workday schedule. <br />K. Payment for Unused Sick Leave. <br />Definition. All employees hired or appointed into the bargaining unit on or prior <br />to December 20, 2022 (as this section does not apply to employees hired or <br />appointed into the bargaining unit after December 20, 2022), except for those <br />involved in disciplinary termination, shall be entitled to payment under the <br />following provisions: <br />1. After ten (10) years of cumulative full-time service with the City, each <br />qualified employee shall be entitled to payment for one-third (1/3) of the <br />total sick leave benefit credited to their 457 account or cash upon the <br />effective date of such termination, not to exceed a maximum limit of four <br />hundred twenty-seven (427) hours, at the rate of pay in effect on the date of <br />such termination. <br />a. At their option, an employee may convert the above lump sum <br />payment option into the retiree health account fund, held by the <br />SAPOA for the purposes of retiree health insurance or long term <br />care insurance premiums to the extent necessary to provide the <br />employee and their designated eligible dependents, if any, with <br />benefits under the health insurance program maintained by the <br />Association. For unused sick leave benefits had this option not been <br />elected, not to exceed a maximum of six hundred forty (640) hours. <br />2. After fifteen (15) years of service, employees shall be entitled to one <br />hundred percent (100%) of the amount of unused sick leave benefits <br />credited to their 457 account or cash upon the effective date of separation, <br />up to a maximum of one thousand six hundred (1,600) hours. <br />3. A lump sum payment shall be made to the beneficiaries of any eligible <br />employee whose death occurs while such employee is an active employee <br />of the City, such payment to be in the amount of one-third (1/3) of the total <br />sick leave benefit credited to the employee's account at the time of their <br />death, and at the rate of pay effective on the date of death. <br />4. Upon the death of any retired employee receiving a benefit under this <br />provision, said benefit will continue to be provided through the Association <br />on behalf of said retired employee to their beneficiary. <br />11.2 Bereavement Leave. An employee shall be granted up to three (3) days leave without loss <br />of pay in case of death of a member of the employee's immediate family. For purposes of <br />this Section only, a "day" shall be defined as the number of hours of work that an employee <br />is required to work according to their specific workday schedule.
