13.9 2% k 62 Service Retirement Benefit for "New Member" Miscellaneous employ The <br />City agrees to provide Miscellaneous employees covered by this MOU who are defined as <br />"New Members" within the meaning of the California Public Employees' Pension Reform <br />Act (PEPRA) of 2013 with the 2% @ 62 Service Retirement benefit <br />Final compensation will be based on the highest annual average compensation eamable <br />during the thirty-six (36) consecutive months immediately preceding the effective date of <br />their retirement, or some other thirty-six (36) consecutive month period designated by the <br />member. <br />Employees covered under the 2% @ 62 retirement formula shall pay one half of the normal <br />cost rate as established each year by Ca1PERS <br />Pre -Taxable Benefit. To the extent permitted by CAPERS and Internal Revenue Service <br />regulations, the City shall make the above employee deductions pre-tax contributions. <br />13.10 Credit for Unused Sick Leave. All sworn and non -sworn employees can have unused <br />accumulated sick leave at the time of retirement converted to additional service credit at <br />the rate of four thousandths (0.004) years of service credit for each day, eight (8) hours per <br />day, of unused sick leave (i.e., two hundred (200) days of sick leave equals eight tenths (.8) <br />additional years of service credit), pursuant to regulations prescribed by Ca1PERS. The <br />maximum total unused sick leave that can be converted shall be two -hundred days (200) <br />eight (8) hours working days equal to one thousand six hundred (1,600) hours. Any <br />accumulated sick leave in excess of one thousand six hundred (1,600) hours shall be <br />forfeited. The City must report only those hours of unused sick leave that were accrued by <br />the employee during the normal course of employment. This section applies to members <br />whose effective date of retirement is within four (4) months or one hundred twenty (120) <br />days of separation from employment. (Government Code Section 20965). <br />Effective the date of City Council adoption of this MOU, the maximum total unused sick <br />leave that can be converted shall be ten (10) eight (8) hour working days equal to eighty <br />(80) hours. Employees hired on or after a contract amendment between the City and <br />Ca1PERS shall not be eligible to convert unused sick leave to Ca1PERS for service credit. <br />13.11 Uniform Allowance. With respect to Safety and Miscellaneous employees who do not <br />qualify as "New Members" under the California Public Employees' Pension Reform Act <br />(PEPRA), the City shall report to Ca1PERS the monetary value of uniforms and uniform <br />maintenance for those employees required to wear uniforms. The monetary value (as of <br />the first date of the MOU) by classification is listed in Exhibit B, entitled "Uniform <br />Allowance by Classification." The amounts listed in Exhibit B may be adjusted (either <br />upward or downward) as the cost of the uniforms and/or their maintenance changes. The <br />value of the Uniform Allowance shall be determined by the City (based on the current cost <br />of the uniforms and/or their maintenance at the time of the report to Ca1PERS) and will be <br />reported to the California Public Employees' Retirement System (CalPERS) for retirement <br />purposes only. <br />Under CCR 571(a), Uniform allowance is defined as "Compensation paid or the monetary <br />value for the purchase, rental and/or maintenance of required clothing, including clothing <br />51 <br />
