ARTICLE XIV <br />14.0 ASSOCIATION LEAVE <br />14.1 Effective the first full pay period following City Council approval of this MOU, the City <br />agrees to grant full-time release from duty for the Association President subject to the <br />following: <br />A. The Association President shall be: <br />1. Required to attend POST training and maintain qualifications (training, <br />certifications, weapons, etc.) to work as a sworn peace officer; <br />2. Eligible to work overtime assignments with prior approval of the Chief of <br />Police; <br />3. Required to report to duty in the event of a declared emergency as <br />determined by the Chief of Police; and <br />4. Assigned to a 5/40 work schedule and shall report time off usage (vacation, <br />sick, etc.) in accordance with City and department policies and procedures. <br />14.2 The City shall pay the Association President the percentage difference between what the <br />Association President receives in base pay plus other forms of special compensation (with <br />the exception of Employer Paid Member Contribution identified in Title 2 California Code <br />of Regulations Section 571), and four and three -fourths percent (4.75%) over the top step <br />pay of the next higher rank including base pay plus other forms of special compensation <br />available to the next higher rank (with the exception of Employer Paid Member <br />Contribution identified in Title 2 California Code of Regulations Section 571). During the <br />time that an employee is the Association President, it is Ca1PERS' determination as to <br />whether any form of special compensation being paid to the POA President can be reported <br />as compensation earnable or pensionable compensation. If Ca1PERS concludes that any <br />form of special compensation cannot be reported as compensation earnable or pensionable <br />compensation it will not be reported. If Ca1PERS concludes that any form of special <br />compensation can be reported as compensation earnable or pensionable compensation it <br />will be reported. <br />14.3 All employees shall donate one (1) floating holiday annually to pay for the Association <br />President's Leave. The floating holiday, which would otherwise accrue in January, will not <br />accrue so that its value can be used throughout the calendar year to pay for the Association <br />President's Leave. <br />Per Section 9.3 of this MOU, newly appointed employees who become employees of the <br />53 <br />
