Authorize the City Manager to execute a construction contract with MMC, Inc. to provide Design -Build services for demolition of existing restroom buildings, installation of new, pre -fabricated buildings, and associated site and utility work in the amount of $2,870,000, with a contingency of $287,000, for a three-year period from April 5, 2023 to April 4, 2026, with an option for two, one-year extensions, subject to non -substantive changes approved by the City Manager and City Attorney. 2. Approve an amendment to the Fiscal Year 2022-23 Capital Improvement Program for the Riverview Park, Heritage Park, Windsor Park, and Angels Park Restrooms Project to be funded from American Rescue Plan Act (ARPA) funds. 3. Determine the recommended actions are exempt from further review in accordance with the California Environmental Quality Act as Categorical Exemption Environmental Review No. ER-2023-28 was filed for this project. DISCUSSION On August 2, 2022, the City Council approved the Revive Santa Ana Spending Plan that reflected the entire American Rescue Plan Act (ARPA) allocation of local fiscal recovery funds. Four City park restrooms were allocated ARPA funding. These existing restrooms are a target for vandalism and require major efforts to maintain due to the old age and existing conditions. This project scope includes the following: demolishing the existing restroom buildings, installing new pre -fabricated restroom buildings, and site improvements to provide an accessible path of travel to these facilities. All four restroom replacement projects are located in ARPA Qualified Census Tracts (QCTs) as allowed by the ARPA rules.
