California Environmental Quality Act (CEQA) Determination <br />City of Santa Ana (Applicant) <br />Septic to Sewer Island (Project) <br />Project Number: C-06-8478-110 <br />As the Deputy Director for the State Water Resources Control Board (State Water <br />Board), Division of Financial Assistance, I have been delegated the authority to approve <br />and execute financing agreements for projects that are routine and non -controversial. <br />The execution of a financing agreement is an action that is subject to CEQA. The <br />authority to make this CEQA determination necessarily accompanies the delegation to <br />approve and execute the financing agreement for this Project. <br />The Applicant is the CEQA Lead Agency and has prepared an Initial <br />Study/Mitigated Negative Declaration (MND) titled Septic to Gravity Sewer <br />Conversion Project, for the Project which was circulated through the Governor's <br />Office of Planning and Research (OPR), State Clearinghouse (No. 2020100428) <br />for review and comments. The Applicant adopted the MND and a Mitigation <br />Monitoring and Reporting Program (MMRP) and approved the Project on <br />December 15, 2020. The Applicant filed a Notice of Determination with the <br />Orange County Clerk on September 20, 2021 and the OPR on September 24, <br />2021. <br />2. The State Water Board is a Responsible Agency under CEQA. A Responsible <br />Agency complies with CEQA by considering the MND and MMRP prepared by <br />the Lead Agency and by reaching its own conclusions on whether and how to <br />approve the Project involved. The State Water Board has independently <br />considered the MND and MMRP, and pursuant to my delegated authority, I make <br />the following determinations regarding the Project: <br />• The Project will not result in any significant adverse water quality impacts. <br />The MND and MMRP include mitigation measures for Tribal Cultural <br />Resources, Geology and Soils, and Hazards and Hazardous Materials, that <br />mitigate potential environmental impacts to less than significant levels for <br />these impact categories. Changes or alterations to the Project based on these <br />mitigation measures are within the responsibility and jurisdiction of other <br />public agencies and are not within the jurisdiction of the State Water Board. <br />Such changes either have been adopted by other relevant agencies or can <br />and should be adopted by such other agencies. <br />A final copy of the MND, MMRP, comments and responses, and records of the <br />financing approval for the Project are available to the general public at the State Water <br />Board, Division of Financial Assistance at 1001 1 Street, 16th Floor, Sacramento, CA <br />95814. <br />
