brs 2/21 /23 <br />RESOLUTION NO. 2023-xxx <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />ACCEPTING THE DONATION OF THE REPAIR AND RESURFACING OF <br />THE BASKETBALL COURT AT PORTOLA PARK <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A. Portola Park in the City of Santa Ana, located at 1700 E. Santa Clara <br />Avenue, has a basketball court available for public use. <br />B. Project Backboard, a 501(c)(3) not for profit organization, renovates public <br />basketball courts and installs large scale works of site specific art on the surface. <br />C. Project Backboard wishes to donate the repair and resurfacing of the <br />basketball court at Portola Park. <br />D. The total value of the donated equipment and services is valued at <br />approximately $75,000 with no cost to the City. <br />E. The acceptance of this donation enhances the public basketball court at <br />Portola Park. <br />Section 2. The City hereby accepts the donation of the repair and resurfacing of <br />the public basketball court at Portola Park, 1700 E. Santa Clara Avenue. <br />Section 3. If any section, subsection, sentence, clause, phrase or word of this <br />Resolution is for any reason held to be invalid by a court of competent jurisdiction, such <br />decision shall not affect the validity of the remaining portions of this Resolution. The City <br />Council hereby declares that it would have passed and adopted this Resolution, and each <br />and all provisions hereof, irrespective of the fact that one or more provisions may be <br />declared invalid. <br />Section 4. This Resolution shall take effect immediately upon its adoption by the <br />City Council, and the Clerk of the Council shall attest to and certify the vote adopting this <br />Resolution. <br />Resolution 2023-xxx <br />Page 1 of 2 <br />
