<br />include, but not be limited to, claims involving security breach, system failure, data
<br />recovery, business interruption, cyber extortion, social engineering, infringement of
<br />intellectual property, including but not limited to infringement of copyright,
<br />trademark, trade dress, invasion of privacy violations, information theft, damage to
<br />or destruction of electronic information, release of private information, and alteration
<br />of electronic information. The policy shall provide coverage for breach response
<br />costs, regulatory fines and penalties as well as credit monitoring expenses.
<br />Technology Professional Liability Errors and Omissions Insurance appropriate
<br />to the Consultant's profession and work hereunder, with limits not less than
<br />$2,000,000 per occurrence, $2,000,000 aggregate. Coverage shall be sufficiently
<br />broad to respond to the duties and obligations as is undertaken by the Consultant in
<br />this agreement and shall include, but not be limited to, claims involving security
<br />breach, system failure, data recovery, business interruption, cyber extortion, social
<br />engineering, invasion of privacy violations, information theft, damage to or
<br />destruction of electronic information, release of private information, and alteration
<br />of electronic information. The policy shall provide coverage for breach response
<br />costs, regulatory fines and penalties as well as credit monitoring expenses.
<br />The Policy shall include, or be endorsed to include, property damage liability
<br />coverage for damage to, alteration of, loss of, or destruction of electronic data
<br />and/or information "property" of the Agency in the care, custody, or control of
<br />the Consultant. If not covered under the Consultant's liability policy, such
<br />"property" coverage of the Agency may be endorsed onto the Consultant's
<br />Cyber Liability Policy.
<br />6. Crime liability insurance with a limit of not less than $1,000,000 per claim with
<br />$2,000,000 in the aggregate. The following requirements apply to the insurance to
<br />be provided by Consultant pursuant to this section:
<br />Consultant shall maintain all insurance required above in full force and effect
<br />for the entire period covered by this Agreement.
<br />ii. Certificates of insurance shall be furnished to the City upon execution of this
<br />Agreement and shall be approved by the City.
<br />iii. City of Santa Ana, its officers, employees, agents and representatives shall be
<br />Additional Insureds with respect to General Liability Insurance and Auto
<br />Liability Insurance is Primary and Non -Contributory.
<br />iv. Certificates and policies shall state that the policies shall not be canceled
<br />without thirty (30) days prior written notice to the City of cancellation with
<br />ten (10) days prior notice for non-payment of premium in accordance with
<br />policy provisions. Similar notice of reduction or material change shall be given
<br />if coverage falls below or is not in compliance with the contract requirements.
<br />v. Consultant shall supply City with a fully executed additional insured
<br />endorsement.
