Approve the recommendation of the Community Development Commission <br />(Commission) to dissolve the Downtown Santa Ana Business Improvement District <br />(BID) and establish a time and place for a public hearing to be held by the City <br />Council on December 20, 2022; or <br />2. Adopt the resolution of intention to levy an annual business license tax assessment <br />for the 2023 calendar year and establish a time and place for a public hearing to be <br />held by the City Council on December 6, 2022. <br />Community Development Commission <br />At its regular meeting on October 26, 2022, by a vote of 6:0 (a Commissioner recused <br />themself from voting on the matter and was not present in the Council Chamber during <br />the vote), the Commission recommended to the City Council to dissolve the BID. The <br />Commission complied with its duty as the advisory board pursuant to Streets and <br />Highways Code section 36530, which is to make a recommendation to the City Council <br />regarding the levy of assessments. Accordingly, the City Council may consider the <br />recommendation of the Commission or the City Council may adopt the resolution of <br />intention to levy an annual business license tax assessment for the 2023 calendar year <br />and continue with the BID. Approval of the resolution of intention to levy an annual <br />business license tax assessment will still require a public hearing where downtown <br />merchants can vote against or speak in favor of the BID renewal.
