Ordinance No. NS-XXX <br />Page 8 of 68 <br /> <br /> <br />15. "Display" means cannabis goods that are stored in the licensed retail business during <br />the hours of operation. <br />16. "Distribution" means the procurement, sale, and transport of cannabis or cannabis <br />products between Licensees. <br />17. "Edible cannabis product" means manufactured cannabis that is intended to be used, <br />in whole or in part, for consumption. An edible cannabis product is not considered food <br />as defined by Section 109935 of the California Health and Safety Code or a drug as <br />defined by Section 109925 of the California Health and Safety Code. <br />18. "Free sample" means any amount of commercial cannabis goods provided to a <br />purchaser of cannabis without cost or payment or exchange of any other thing of <br />value. <br />19. "Labor Peace Agreement" means a legally binding agreement between an employer <br />and a bona fide labor organization in which the employer agrees to remain neutral in <br />the event its employees wish to unionize, as described more fully in Business and <br />Professions Code 26001(z), as amended from time to time. For the purposes of this <br />Chapter, a "Bona Fide Labor Organization" means any organization or any agency or <br />employee representation committee or any local unit thereof in which employees <br />participate, and exists for the purpose, in whole or in part, of working with employers <br />concerning grievances, labor disputes, wages, hours of employment or conditions of <br />work, which labor organization is not found to be or to have been financed in whole or <br />in part, interfered with, dominated or controlled by the employer or any employer <br />association. <br />20. "License/Licensee" means a license issued by the State and includes both an A- <br />license (Adult-Use) and an M-license (Medicinal), and the holder of such license. <br />21. "Manufacturer" means a Licensee that conducts the production, preparation, <br />propagation, or compounding of cannabis or cannabis products either directly or <br />indirectly or by extraction methods, or independently by means of chemical synthesis, <br />or by a combination of extraction and chemical synthesis at a fixed location that <br />packages or repackages cannabis or cannabis products or labels or relabels its <br />container. <br />22. "Manufacturing" means all aspects of the extraction and/or infusion processes, <br />including processing, preparing, holding, storing, packaging, or labeling of cannabis <br />products. Manufacturing also includes any processing, preparing, propagating, <br />holding, or storing of components and ingredients. <br />22.5. “Shared Manufacturing” means manufacturers who work in a shared-use <br />facility. Shared-use facilities are places where multiple shared manufacturers <br />engaging in cannabis extraction using butter or cooking oils, infusion, and/or <br />packaging and labeling rotate on a schedule and share space and equipment.
