Location and Separation requirements for all commercial cannabis retail <br />businesses. <br />A. Commercial cannabis businesses may only operate within an area in accordance with <br />the Commercial Cannabis Eligible Areas Map as adopted by resolution of the City <br />Council. <br />B. No commercial cannabis retail business shall be located within five hundred (500) feet <br />of another retail cannabis business, as measured from primary entrance of the <br />business to primary entrance of the other business. <br />C. No commercial cannabis business shall be located within one thousand (1,000) feet <br />of any: <br />1. School (K-12) as defined by Section 11362.768 of the Health and Safety Code, <br />as indicated by the Commercial Cannabis Eligible Areas Map; or <br />2. Park, as indicated by the Commercial Cannabis Eligible Areas Map; or <br />3. Residential zoning district, as indicated by the Commercial Cannabis Eligible <br />Areas Map. <br />Sec. 40-7. Relocation of commercial cannabis retail businesses (medicinal and/or <br />adult-use). <br />(a) Relocation of an existing medical marijuana collective, medical marijuana cooperative, <br />and/or adult-use cannabis retail business as defined in this Chapter is permitted within <br />the City of Santa Ana subject to the following: <br />(1) The medical marijuana collective, medical marijuana cooperative, and/or adult-use <br />cannabis retail business must hold a valid RSP, business license, and the <br />appropriate State commercial cannabis license, and be operating with all required <br />permits and licenses. For the purposes of this sub-section, “operating” means a <br />medical marijuana collective, medical marijuana cooperative, and/or adult-use <br />cannabis retail business currently holding a valid RSP and Santa Ana business <br />license. <br />(2) The existing RSP holder and existing location must be in good standing, including <br />but not limited to full compliance with all requirements of the Santa Ana Municipal <br />Code, no active code enforcement and/or building safety violations, no violations
