Rent Stabilization and Just Cause Eviction Ordinances <br />October 4, 2022 <br />Page 3 <br />2 <br />9 <br />7 <br />7 <br />RSG’s Long-Term Implementation Plan provides detailed information on the membership <br />of Rental Housing Boards in other jurisdictions. These options are provided as Exhibit 3. <br />Other options for the composition of the Board includes: <br />Option # 1: Three (3) tenants (including one (1) mobilehome tenant), three (3) <br />landlords, and one (1) at-large member with no financial interest; <br />Option # 2: Four (4) tenants (including one (1) mobilehome tenant), two (2) landlords, <br />and one (1) at-large member with no financial interest; <br />Option # 3: Three (3) tenants (including one (1) mobilehome tenant), two (2) <br />landlords, and (2) at-large members with no financial interest; or <br />Option # 4: Two (2) tenants (including one (1) mobilehome tenant), two (2) landlords, <br />and three (3) at-large members with no financial interest (original staff <br />recommendation). <br />The draft amendment pertaining to the Rental Housing Board can be found in Division 5, <br />Section 8-3180 of the amended Ordinance. <br />Additional Administrative Considerations <br />In addition to the foregoing, at the September 6, 2022 meeting the City Council discussed <br />the following items that will be implemented in the Work Plan, Fee Study, and subsequent <br />Policies and Procedures: <br />•Staff will ensure that the Fee Study accounts for the most efficient way to <br />implement the Long-Term Implementation Plan. Specifically, the rental registry fee <br />will be as low and lean as possible to not create an unnecessary burden on tenants <br />and landlords; staff will seek to blend a hybrid of services between consultants and <br />city staff; and staff will identify ways to build upon other existing services across <br />the City to administer the ordinance. The Fee Study and rental registry fee will be <br />guided by these principles. <br />•Staff will present the following options as it relates to the fees associated with a <br />Fair Return Petition, Capital Improvement Petition, and Tenant Petition: <br />o Financial impact of having petition fees separate from the rental registry fee; <br />o Financial impact of having petition fees included in the rental registry fee; or <br />o Financial impact of having no petition fees. <br />•Staff will work in collaboration with the City’s Code Enforcement Division and City <br />Attorney’s Office to enforce the ordinance. <br />Next Steps <br />Following City Council approval of the first reading of the Ordinance amending the Rent <br />Stabilization and Just Cause Eviction Ordinances, staff will incorporate City Council <br />feedback and return for a second reading of the Ordinance. <br />FISCAL IMPACT <br />There is no fiscal impact associated with this action.
