Public Works Agency <br />www.santa-ana.org/pw <br />Item # 19 <br />City of Santa Ana <br />20 Civic Center Plaza, Santa Ana, CA 92701 <br /> Staff Report <br />September 20, 2022 <br />TOPIC: Agreement with County of Orange for Building Overhangs on Ross Street <br />AGENDA TITLE: <br />Approve a License Agreement with the County of Orange for use of Ross Street Right-of <br />Way for Building Overhangs <br />RECOMMENDED ACTION <br />Authorize the City Manager to execute a license agreement with the County of Orange, <br />a political subdivision of the State of California, for use of public right-of-way to <br />accommodate overhangs for two County buildings within Ross Street between Santa Ana <br />Boulevard and Civic Center Drive, subject to non-substantive changes approved by the <br />City Manager and the City Attorney. <br />DISCUSSION <br />During the past decade, the County of Orange (County) has been in the process re- <br />developing the block bordered by Santa Ana Boulevard, Ross Street, Civic Center Drive <br />and Broadway. In conjunction with the project, the County of Orange dedicated to the City <br />an 18’ wide strip of land along the east side of Ross Street for street right of way on <br />November 4, 2021. <br />The County has completed two new buildings fronting Ross Street. Construction of the <br />County Administrative South (CAS) building at 601 North Ross Street was completed in <br />2020, and construction of the County Administrative North (CAN) building at 400 West <br />Civic Center Drive was completed in summer 2022. The County constructed an <br />overhanging roof as a design element on both buildings. The overhangs are situated <br />within the City’s newly dedicated Ross Street right-of-way above the surface of the street, <br />approximately seven feet into the right of way for the CAN building, and approximately 11 <br />feet into the right of way for the CAS building (Exhibits 1 and 2). <br />To document the County’s right to use, maintain, and repair its overhangs, to identify <br />insurance requirements, and to prescribe terms of indemnification of the City by the <br />County, the City and County will to enter into a License Agreement (Exhibit 3).
