Ordinance No. NS-XXX <br />Page 33 of 66 <br /> <br /> <br />opportunity to cure any incomplete or deficient application prior to the conclusion <br />of the application processing term, if such time period is applicable. <br />3.1. Commercial Cannabis – Selection Process for New Commercial Cannabis Retail <br />Businesses after January 1, 2023. <br />a. Measure BB Waitlist Entities. The commercial cannabis selection process for new <br />retail licenses available after January 1, 2023 for entities on the Waitlist, as defined <br />by Section 40-104 of this Chapter, is as follows: <br /> <br />i. Those entities listed on the Waitlist as defined and set forth in Article II of <br />this Chapter shall be afforded first priority to submit a complete RSP <br />application for a new commercial cannabis retail business. Said RSP <br />application must be submitted no later than March 30, 2023. Failure to <br />submit a complete RSP application by March 30, 2023 shall result in <br />disqualification to obtain an RSP. <br /> <br />ii. The RSP application for Waitlisted entities must be for the same location as <br />identified on the Waitlist. The location must comply with the 500-foot <br />separation required by Section 40-6 of this Chapter from any operating or <br />selected entity identified during the Measure BB lottery process, or the <br />City’s evaluative process for adult-use retailers in 2018. <br /> <br />iii. If there remain additional commercial cannabis retail business permits <br />available after steps i and ii, above, then the City shall open a new window <br />for applications as specified in subsection b, below. <br /> <br />b. Entities Selected during the City’s 2018 Evaluative Process. The commercial <br />cannabis selection process for new retail licenses available after January 1, 2023 <br />for entities selected during the City’s 2018 evaluative process is as follows: <br /> <br />i. If there remain additional commercial cannabis retail business permits <br />available after the selection process identified in subsection a, above, then <br />the City shall open a new window for applications as specified below. <br /> <br />ii. Those entities scored as part of the City’s evaluative process for adult-use <br />retailers in 2018 pursuant to this Chapter may submit an RSP application <br />after May 1, 2023 but no later than June 30, 2023. Failure to submit a <br />complete RSP application by July 31, 2023 shall result in disqualification to <br />obtain an RSP. <br /> <br />iii. Applications shall be considered in order of their scoring from the City’s <br />evaluative process for adult-use retailers in 2018.
