Ordinance No. NS-XXX <br />Page 5 of 73 <br /> <br /> <br />satisfactory to the Executive Director of Planning and Building and the City Attorney, <br />and containing those provisions necessary to ensure that the requirements of this <br />article are satisfied. A distinct Commercial Cannabis Operating Agreement shall be <br />required for each location of a commercial cannabis business activity taking place at <br />an approved Commercial Cannabis Business Community Benefits Required. <br />1. Effective January 1, 2023, all commercial cannabis businesses operating in the <br />City shall be required to provide community benefits through a Community Benefits <br />and Sustainable Business Practices Plan in a format acceptable by the City as <br />reviewed and verified from time to time as a component of issuance of a regulatory <br />safety permit (RSP). Each commercial cannabis business operating in the City <br />shall commit to: <br />a) Hiring a minimum percentage of staff from the Santa Ana community, including <br />volunteers, employees, and managers; <br />b) Local sourcing of construction materials and cannabis products from within <br />Santa Ana; <br />c) Pay prevailing industry wages; <br />d) Other community benefit commitments that promote health and sustainability <br />of the community, including, but not limited to: <br />a. Transit incentives to reduce individual/private automobile use; <br />b. Healthy living incentives, including but not limited to health club <br />memberships, nutritional counseling, adequate break times, onsite physical <br />health and ergonomic trainings, and other measures intended to promote <br />healthy living of staff; <br />c. Constructing the facility with “green” technologies intended to reduce waste, <br />electricity use, and water use; <br />d. Engaging the local artist community; and <br />e. Any other measures designed to promote the community benefits principles <br />outlined in this subsection. <br />2. Documentation of the aforementioned community benefits shall be submitted to <br />the Code Enforcement Division on an annual basis, including as part of a renewal <br />application for an RSP during the annual renewal process. Said documentation <br />shall detail said business’s community benefits obligations as mandated by this <br />Chapter and shall be evaluated for satisfaction by the Executive Director of the <br />Planning and Building Agency or his or her designee. Failure to provide the <br />requested documentation shall result in a suspension or revocation of an RSP, or <br />delay or denial of an RSP renewal application, as applicable. <br />Exhibit 1
