Ordinance No. NS-XXX <br />Page 28 of 73 <br /> <br /> <br />additional applications unless an LUC application for a temporary consumption <br />and/or special event is withdrawn or determined by the City to be incomplete. <br />Once six (6) complete LUC applications are accepted, no new LUC applications <br />for a temporary consumption and/or special event may be accepted for the <br />remainder of the calendar year. <br />(d) Applications for temporary consumption and/or special event LUCs must be <br />submitted at least 30 days and no more than 60 days prior to the event date. <br />(e) A single operator shall be permitted to conduct one (1) independent temporary <br />consumption and/or special event LUC approved per calendar year, except that <br />multiple operators may form a single event and file a single application. <br />(f) No more than two (2) temporary consumption and/or special event LUCs shall <br />be approved for any single month. <br />(g) The event shall last no longer than 48 hours and in all cases shall begin no <br />earlier than 8:00 a.m. and end no later than 10:00 p.m. <br />(h) Location. Temporary consumption and/or special events: <br />i. May be on the same site as a commercial cannabis medicinal or adult-use <br />retail business. <br />ii. May be offsite at a private or City-owned facility subject to approval by the <br />operator of a valid adult-use and/or medicinal retail business RSP and by <br />third-party landlord approval, if applicable. <br />(i) Medicinal or adult-use cannabis and cannabis products may be sold on the <br />premises during temporary consumption and/or special events, subject to the <br />following: <br />i. The operator must hold a valid adult-use and/or medicinal retail business <br />RSP. <br />ii. Products shall be sold for on-site consumption only. All cannabis products <br />purchased and opened at the facility must be smoked or consumed on site <br />and shall not be permitted to leave the facility. <br />iii. All products consumed or smoked on premises shall be sold at the facility. <br />Operators shall not permit patrons to bring their own personal cannabis or <br />cannabis products to the event. <br />(j) Cannabis may only be smoked within the enclosed portion(s) of a temporary <br />consumption site as may be allowable under state law, subject to sufficient odor <br />control and ventilation equipment. Open-air smoking is prohibited. <br />Exhibit 1
