The City Council declares that no evidence of new significant <br />impacts or any new information of “substantial importance,” as defined by State CEQA <br />Guidelines Section 15088.5, has been received by the City after circulation of the Final <br />Draft Recirculated PEIR that would require recirculation of the PEIR. <br /> <br />Section 4. The City Council hereby: <br /> <br /> A. Certifies the Final Recirculated PEIR based on the entirety of the record of <br />proceedings. <br /> <br /> B. Adopts the Findings of Fact and Statement of Overriding Considerations, <br />attached hereto and incorporated herein as Exhibit B, after balancing the significant <br />and unavoidable air quality, cultural resources, greenhouse gas emissions, noise, <br />recreation, and population and housing impacts of the proposed project against the <br />benefits of the proposed project. <br /> <br /> C. Adopts the Mitigation Monitoring and Reporting Program attached hereto <br />and incorporated herein as Exhibit C, consistent with Public Resources Code Section <br />21081.6; makes implementation of the mitigation measures in the Mitigation Monitoring <br />and Reporting Program a condition of approval of the project; and finds that in the event <br />of any inconsistencies between the mitigation measures set forth herein and the <br />Mitigation Monitoring and Reporting Program, the Mitigation Monitoring and Reporting <br />Program shall control. <br /> <br /> D. Approves the project, based upon the entire record before it, including the <br />Final Recirculated PEIR, Findings of Fact and Statement of Overriding Considerations, <br />and all written and oral evidence presented. <br /> <br /> E. Directs City staff to cause a Notice of Determination to be filed and posted <br />with the County of Orange Registrar-Recorder/County Clerk and the State <br />Clearinghouse within five working days of the City Council’s final project approval. <br /> <br />Section 5. This Resolution shall take effect immediately upon its adoption <br />by the City Council, and the Clerk of the Council shall attest to and certify the vote <br />adopting this Resolution. <br /> <br /> ADOPTED this _____ day of ____________, 2022. <br /> <br /> <br /> <br />________________________________ <br />Vicente Sarmiento <br />Mayor <br />
