Ordinance No. NS-XXX <br />Page 14 of 42 <br /> <br />separated recyclable materials, and source separated organic waste, for placement in <br />containers specifically designated for those materials. <br /> Tier one commercial edible food generator shall mean a commercial edible food <br />generator that is one of the following, each as defined in 14 CCR Section 18982(a)(73): <br />supermarket; grocery store with a total facility size equal to or greater than 10,000 square <br />feet; food service provider; food distributor; or wholesale food vendor. If the definition in <br />14 CCR Section 18982(a)(73) of tier one commercial edible food generator differs from <br />this definition, the definition in 14 CCR Section 18982(a)(73) shall apply to this article. <br /> Tier two commercial edible food generator shall mean a commercial edible food <br />generator that is one of the following, each as defined in 14 CCR Section 18982(a)(74): <br />restaurant with 250 or more seats, or a total facility size equal to or greater than 5,000 <br />square feet; hotel with an on-site food facility and 200 or more rooms; health facility with <br />an on-site food facility and 100 or more beds; large venue; large event; a state agency <br />with a cafeteria with 250 or more seats or total cafeteria facility size equal to or greater <br />than 5,000 square feet; or a local education agency with an on-site food facility. If the <br />definition in 14 CCR Section 18982(a)(74) of tier two commercial edible food generator <br />differs from this definition, the definition in 14 CCR Section 18982(a)(74) shall apply to <br />this article. <br /> Uncontainerized green waste and yard waste collection service or uncontainerized <br />service means a collection service that collects green waste and yard waste that is placed <br />in a pile or bagged for collection on the street in front of a generator’s house or place of <br />business for collection and transported to a facility that recovers source separated organic <br />waste, or as otherwise defined in 14 CCR Section 18982(a)(75). <br /> Waste reduction and recycling plan or WRRP shall mean a completed waste <br />management plan form, approved by the city for the purpose of compliance with this <br />article, submitted by the applicant for any CALGreen covered or noncovered project. <br />The first portion of the form is submitted when applying for a permit, and the second <br />portion when the project is completed. <br /> <br /> Wholesale food vendor shall mean a business or establishment engaged in the <br />merchant wholesale distribution of food, where food (including fruits and vegetables) is <br />received, shipped, stored, or prepared for distribution to a retailer, warehouse, distributor, <br />or other destination, or as otherwise defined in 14 CCR Section 18982(a)(76). <br /> Yard waste shall mean any wastes generated from the maintenance or alteration <br />of public, commercial, or residential landscapes, including but not limited to, leaves, yard <br />clippings, tree trimming, brush, weeds, and prunings, which have been source separated <br />from other solid waste. Yard waste is a subset of organic materials and excludes <br />hazardous materials. <br /> Sec. 16-29.5. - Administration. <br /> (a) The executive director may make rules and determinations pertaining to the <br />storage, collection, recycling, diversion, conveyance, and disposal of solid waste
