(hd) "Proprietor" means a person with an ownership or managerial interest in a business. An
<br />ownership interest shall be deemed to exist when a person has a ten percent (10%) or greater
<br />interest in the stock, assets, or income of a business other than the sole interest of security for
<br />debt. A managerial interest shall be deemed to exist when a person can or does have or share
<br />ultimate control over the day‐to‐day operations of a business.
<br />(i) “Recreation Facility” means an area, place, structure, or other facility that is used either
<br />permanently or temporarily for community recreation, even though it may be used for other
<br />purposes, and includes but is not limited to a gymnasium, playing court, playing field, and
<br />swimming pool.
<br />(e) "Tobacco paraphernalia" means cigarette papers or wrappers, pipes, holders of smoking
<br />materials of all types, cigarette rolling machines, and any other item designed for the smoking,
<br />preparation, storing, or consumption of tobacco products.
<br />(jf) Tobacco product" means: (1) any substance containing, made of, or derived from tobacco or
<br />nicotine that is intended for human consumption or is likely to be consumed leaf, whether
<br />inhaled, absorbed, or ingested by any other means, including but not limited to cigarettes,
<br />cigars, pipe tobacco, hookah tobacco, snuff, chewing tobacco, dipping tobacco, bidis, or any
<br />other preparation of tobacco; or (2) any electronic smoking device and any substances that may
<br />be aerosolized or vaporized by such device, whether or not the substance contains nicotine; or
<br />(3) any component, part, or accessory of (1) or (2), whether or not any of these contains
<br />tobacco or nicotine, including but not limited to filters, rolling papers, blunt or hemp wraps,
<br />hookahs, mouthpieces, and pipes. any product or formulation of matter containing biologically
<br />active amounts of nicotine that is manufactured, sold, offered for sale, or otherwise distributed
<br />with the expectation that the product or matter will be introduced into the human body, but
<br />“Tobacco product” does not mean drugs, devices, or combination products authorized for sale
<br />by the U.S. Food and Drug Administration, as those terms are defined in the Federal Food, Drug,
<br />and Cosmetic Actinclude any product specifically approved by the United States Food and Drug
<br />Administration for use in treating nicotine or tobacco product dependence.
<br />(kg) "Tobacco retailer" means any person or business who sells, offers for sale, or does or offers
<br />to exchange for any form of consideration, tobacco, tobacco products, , or tobacco
<br />paraphernalia, or who distributes free or low cost samples of tobacco products or tobacco
<br />paraphernalia. "Tobacco retailing" shall mean the doing of any of these things. This definition is
<br />without regard to the quantity of tobacco, tobacco products , or tobacco paraphernalia sold,
<br />offered for sale, exchanged, or offered for exchange.
<br />(l) “Youth‐Oriented Facility” means a parcel in the city that is occupied by:
<br />(1) a private or public kindergarten, elementary, middle, junior high, or high school;
<br />(2) a library open to the public;
<br />(3) a playground open to the public;
<br />(4) a youth center, defined as a facility where children, ages 6 to 17, inclusive,
<br />come together for programs and activities;
