<br />Page | 26 <br />9138-126780\1512539.3 <br />contractors, if any, and their subcontractors, sub-subcontractors, officers and employees for damages <br />caused by fire or other perils to the extent paid by the Builder’s Risk insurance, except such rights as <br />they may have to the proceeds of such insurance. The Contractor shall require of its subcontractors <br />and sub-subcontractors by appropriate agreements, similar waivers, each in favor of all other parties <br />enumerated in the preceding sentence. <br /> <br />(g) The policy or policies of insurance maintained by the TENANT’S <br />CONTRACTOR AFTER CONSTRUCTION shall provide the minimum limits and coverage as <br />set forth below when performing maintenance and minor work after the building is in operation: <br />Coverages Minimum Limits <br />Commercial General Liability <br /> <br />$1,000,000 per occurrence <br />$2,000,000 aggregate <br />Automobile Liability including coverage for owned, <br />non-owned and hired vehicles <br />$1,000,000 limit per occurrence <br />Workers' Compensation Statutory Minimum <br />Employers' Liability Insurance $1,000,000 per occurrence <br /> <br />8.1.7. Required Coverage Forms. <br />(a) The Commercial General Liability coverage shall be written on <br />Insurance Services Office (ISO) form CG 00 01, or a substitute form providing liability coverage at <br />least as broad. <br />(b) The Business Auto Liability coverage shall be written on ISO form <br />CA 00 01, CA 00 05, CA 00 12, CA 00 20, or a substitute form providing liability coverage as broad. <br />8.1.8. Required Endorsements. The Commercial General Liability policy shall <br />contain the following endorsements, which shall accompany the Certificate of insurance: <br />1) An Additional Insured endorsement using ISO form CG 20 26 04 13 or a form at least as <br />broad naming the City of Santa Ana, and their respective elected and appointed officials, <br />officers, employees, agents as Additional Insureds. Blanket coverage may also be <br />provided which will state, as required by Lease. <br />2) A Products and Completed Operations endorsement using ISO Form CG2037 (ed.04/13) <br />or a form at least as broad, or an acceptable alternative is the ISO from CG2010 (ed. <br />11/85). (Pertains to contractors and subcontractors performing major construction). <br />Contractors shall maintain Products and Completed Operations coverage for ten (10) <br />years following completion of construction. <br />The Contactors Pollution Liability and Pollution Liability policies shall contain the followin g <br />endorsements, which shall accompany the Certificate of Insurance: <br />EXHIBIT 5
