Resolution No. 2021-XXX <br />Page 1 of 3 <br />RESOLUTION NO. 2021-XXX <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA LEVYING AN ASSESSMENT FOR THE <br />DOWNTOWN SANTA ANA BUSINESS IMPROVEMENT <br />DISTRICT FOR CALENDAR YEAR 2022 <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A.On February 6, 1984, the City Council, by Ordinance No. NS -1715, <br />established the Downtown Santa Ana Business Improvement Area <br />pursuant to California Streets and Highways Code Sections 36500, et seq. <br />(the “BID Law”). <br />B.On November 2, 2021, the City Council received the 2022 Annual <br />Assessment Report for the Downtown Santa Ana Business Improvement <br />District (the “Report”). <br />C.On November 2, 2021, the City Council adopted Resolution 2021-063 <br />approving the Report and setting a public hearing for December 7, 2021, at <br />which time protests could be made to the proposed levy of the 2022 annual <br />assessment for the Downtown Santa Ana Business Improvement District <br />(the “Annual Assessment”). <br />D.On December 7, 2021, at the time and place called for in Resolution 2021- <br />063, the City Council conducted a duly noticed public hearing at which <br />written and oral protests to the proposed Annual Assessment were made <br />and considered as provided in Streets and Highways Code sections 36524 <br />and 36525. <br />E.Qualifying written protests constituting a majority of the owners of the <br />businesses paying the Annual Assessment were not received at or before <br />the conclusion of the public hearing. <br />Section 2. The 2022 Assessment Report is hereby confirmed, and the levy of <br />an assessment for the calendar year 2022 in accordance with Attachment B of the Report, <br />a copy of which is attached hereto and incorporated herein by reference, is hereby <br />approved. <br />EXHIBIT 3
