(9)CITY OF SANTA ANA <br />Commander. Upon receipt of the Contractor's final written appeal, the Chief of Police shall issue <br />a written decision within (10) business days. The decision of the Chief of Police shall be final. <br />Disciplinary action shall not be imposed until the appeal process has been exhausted. However, if <br />the conduct of the Contractor is deemed to be so egregious or poses a danger to public <br />safety, the City may exercise its right to immediately suspend the Contractor as set forth in this <br />agreement. Failure to submit a written appeal will waive the Contractor's right to <br />further appeal and disciplinary action shall be imposed. <br />In the event the City serves the Contractor with Notice of Termination from the Contract and <br />the Contractor seeks an appeal, the contractor will retain its position on the rotation and <br />disciplinary action will be delayed pending the appeal process. In the event the CITY elects to <br />modify the discipline imposed on the Contractor, the Contractor agrees they shall not be entitled <br />to recover any costs, compensation, damages, losses, and/or expenses of any type or <br />description from or file a claim against the City, its officers, employees, and appointees, arising <br />out of or related to, in any manner, a violation alleged against, or discipline imposed upon the <br />Contractor. <br />W. SUPERVISION OF CONTRACT AND MEETINGS WITH CITY <br />All work shall meet with the approval of the Santa Ana Police Department. As determined <br />necessary by the City, there shall be a minimum of one monthly meeting with the Contractor and <br />the City representative during the first year to determine progress and to establish areas needing <br />attention. Status reports of activities performed by the Contractor will be submitted in writing to <br />the City on a monthly basis or as determined necessary by the City. <br />Any specific problem area which does not meet the conditions of the specifications set forth in <br />Exhibit A or the Agreement shall be called to the attention of the Contractor and if not corrected, <br />may result in the Contractor being found in default of this agreement which may result in <br />suspension from the rotation list until the issue(s) is/are correct in a manner satisfactory to the <br />City or termination of the Agreement. <br />RFP No. 21-060 Police Rotational Towing and Storage Services Page 36 of 39 <br />
