review and approval prior to submission to any other licensing or <br />government entity; <br />iii.Submission of plans and applications as needed to City Planning <br />and Building Department; <br />iv.Request for construction bids; <br />v.Complete construction; and <br />v1. Finalize all permits necessary to use Facilities for TRF's intended <br />use as authorized pursuant to this Agreement, including but not <br />limited to, obtaining a certificate of occupancy or related <br />documents as necessary. <br />E.The Parties acknowledge that TRF has secured grant funding to support its <br />use of the Facilities to provide licensed childcare and that TRF's grant <br />funding requires approval by other government entities of expenses above <br />a certain threshold and paid with grant funds. <br />F.After improvements are completed, TRF will not make any additional <br />improvements or alterations to the Facilities without the prior written <br />consent of the City Manager. Any additions, repairs, replacements, or <br />improvements made by TRF shall not be removed by TRF without the <br />written approval of the City Manager. The Facilities, including any area <br />utilized by TRF, shall remain the property of the City. City reserves the <br />right upon expiration or termination of this Agreement to require TRF to <br />return Facilities to their original condition. <br />5.Operational Rules and Regulations. TRF shall comply with all operational rules <br />and regulations promulgated by the Executive Director of Parks, Recreation and <br />Community Services, City Manager or City Council regarding the operation of <br />City's Corbin Center and El Salvador Center, including but not limited to hours of <br />operation. <br />6.Maintenance. TRF shall at all times maintain Facilities in good condition and <br />repair, and in a clean and safe condition reasonably satisfactory to the City <br />Manager. <br />7.Damage to Facilities. TRF shall be liable for any damages to the Facilities caused <br />by any act of negligence ofTRF, its partners, agents, servants, contractors, <br />representatives, guests, employees, invites or customers. City may at its option, <br />repair such damage, and TRF agrees to reimburse City for the total cost ofrepair. <br />8.Utilities. TRF shall pay when due all charges for water, gas, electricity, <br />telephone, internet, video ( c�ble or satellite), trash and other public utility charges <br />furnished to TRF.
