Such reduction could adversely impact the property tax <br />revenues received by the City, which could significantly and adversely affect the operations and finances of the <br />City and the City’s ability to pay the Bonds. See the caption “—Assessed Valued of Taxable Property.” <br />The City has not independently verified, but is not aware of, the presence of any hazardous substances <br />in the City except in connection with everyday business activities such as gas stations and dry cleaning <br />establishments having a material adverse effect on property values in the City. Hazardous substance liabilities <br />may arise in the future with respect to any of the property in the City resulting from the existence, currently, of <br />a substance presently classified as hazardous but which has not been released or the release of which is not <br />presently threatened, or may arise in the future resulting from the existence, currently, on the parcel of a <br />substance not presently classified as hazardous but which may in the future be so classified. Additionally, such <br />liabilities may arise from the method of handling such substance. These possibilities could significantly affect <br />the value of a parcel. <br />Cybersecurity <br />Municipal agencies, like other business entities, face significant risks relating to the use and application <br />of computer software and hardware. Recently, there have been significant cybersecurity incidents affecting <br />municipal agencies, including a freeze affecting computer systems of the City of Atlanta, an attack on the City <br />of Baltimore’s 911 system, an attack on the Colorado Department of Transportation’s computers and an attack <br />that resulted in the temporary closure of the Port of Los Angeles’ largest terminal. <br />The City employs a multi-level cyber protection scheme that includes network firewalls, server- and <br />personal computer- level anti-virus software, anti-spam/malware software, email protection as well as intrusion <br />protection. The City employs intrusion protection and expects that any such disruptions would be temporary in <br />nature. To date, the City has not experienced a major attack on its computer operating systems. However, no <br />assurances can be given that the City’s security and operational control measures will be successful in guarding <br />against any and each cyber threat and attack. The results of any attack on the City’s computer and information <br />technology systems could impact its operations and damage the City’s digital networks and systems, and the <br />costs of remedying any such damage could be substantial. <br />Limitation on Sources of Revenues <br />Although the Bonds are payable from all lawfully available funds of the City, the City has no obligation <br />to levy taxes, assessments, fees or charges in order to raise sufficient revenues to pay the Bonds. In the event <br />that the City were to choose to do so, the State Constitution contains significant limitations and imposes <br />significant procedural requirements which affect the City’s ability to increase City revenues. In addition, under <br />the State Constitution, voters of the State have the ability to initiate legislation and require a public vote on <br />legislation passed by the State Legislature through the powers of initiative and referendum, respectively. The <br />City is unable to predict whether any such initiatives or referenda might be submitted to or approved by the <br />voters, the nature of such initiatives or referenda or their potential impact on the City and its operations. <br />See the caption “CONSTITUTIONAL AND STATUTORY LIMITATIONS ON TAXES AND <br />APPROPRIATIONS.” <br />Economy of City and State <br />A deterioration in the level of economic activity in the City, the State or the United States, including as <br />a result of the COVID-19 outbreak that is discussed under the caption “THE CITY—COVID-19 Outbreak,” <br />could have a material adverse effect on the City’s general revenues and on the ability of the City to pay principal <br />of and interest on the Bonds.
