Public engagement activities are required for projects undergoing a <br />Preliminary Endangerment Assessment (“PEA”), RAW, or RAP. Any such <br />public participation activities shall be conducted in accordance with Health <br />and Safety Code sections 25358.7 (and 25356.1(e), if conducting a RAP) <br />and with DTSC's review and approval. <br />(4) Tribal Outreach and Consultation: <br />a. DTSC will coordinate with DTSC’s Office of Environmental Equity to ensure <br />compliance with DTSC’s Tribal Consultation Policy. <br />(5) Health and Safety Plan: <br />a. The Housing Authority of the City of Santa Ana and County of Orange will <br />prepare and submit a Site Health and Safety Plan in accordance with <br />California Code of Regulations, Title 8, Section 5192. <br />(6) Quality Assurance/Quality Control (“QA/QC”) Plan: <br />a. All sampling and analysis conducted by the Housing Authority of the City of <br />Santa Ana and County of Orange under this agreement shall be performed <br />in accordance with a QA/QC Plan. <br />The scope of work may be revised in the future to accommodate additional tasks, <br />including additional oversight during the clean-up program. <br />The County and City is required to pay all costs incurred by DTSC in association with <br />preparation of the Standard Voluntary Agreement and for oversight activities, including <br />review of documents, conducted prior to the effective date of the Agreement; and all costs <br />incurred by DTSC in providing oversight pursuant to the Agreement. DTSC estimates <br />their total oversight costs to be $27,917. This is an estimate and cannot be relied upon <br />as the final cost figure. Therefore, staff is recommending approval of an amount not to <br />exceed $40,000, such that any additional costs beyond the $27,917 estimate can be <br />authorized for payment without returning to the City Council for approval. The $40,000 <br />amount will be split 50/50 with the County of Orange. <br />FISCAL IMPACT <br />The Housing Authority of the City of Santa Ana and the County of Orange is required to <br />pay for all costs incurred by DTSC in association with the preparation of the agreement, <br />and for oversight activities, including review of documents, conducted prior to the effective <br />date of the agreement; and all costs incurred by DTSC in providing oversight pursuant to <br />the execution of the agreement, including review of associated documents, and oversight <br />of field activities. <br />The City Council’s action will authorize an amount not to exceed $40,000. The agreement <br />requires an advance payment of $13,958 from the Housing Authority of the City of Santa <br />Ana and the County of Orange to DTSC no later than 10 days after the full execution of <br />the agreement. This advance payment will be split 50/50 with the County of Orange.
