Administrative Plan 5/1/21 <br /> Page TSP-15 <br />Permissive Denial <br />Notice PIH 2021-15 lists permissive prohibitions for which the PHA may, but is not required to, <br />deny admission to EHV families. The notice also lists prohibitions that, while allowable under <br />the HCV program, may not be used to deny assistance for EHV families. <br />If the PHA intends to establish permissive prohibition policies for EHV applicants, the PHA <br />must first consult with its CoC partner to understand the impact that the proposed prohibitions <br />may have on referrals and must take the CoC’s recommendations into consideration. <br />PHA Policy <br />In consultation with the CoC, the PHA will apply permissive prohibition to the screening <br />of EHV applicants. Determinations using permissive prohibitions will be made based on <br />an individualized assessment of relevant mitigating information in accordance with <br />policies in Section 3-III.E. <br />The PHA will establish the following permissive prohibitions: <br />If the PHA determines that any household member is currently engaged in, or has <br />engaged in within the previous 12 months: <br />Violent criminal activity <br />Other criminal activity that may threaten the health, safety, or right to <br />peaceful enjoyment of the premises by other residents or persons residing <br />in the immediate vicinity <br />If the family engages in or threatens abusive or violent behavior toward PHA <br />personnel. <br />The PHA will also deny assistance to household members already receiving assistance <br />from another program in accordance with Section 9.h. of Notice PIH 2021-15. <br />Prohibitions based on criminal activity for the eligible EHV populations regarding drug <br />possession will be considered apart from criminal activity against persons (i.e., violent <br />criminal activity). <br />EXHIBIT 3
