INSURANCE NOT ON FILE N-2023-196 <br />WORK MAY NOT PROCEED AGREEMENT FOR PERFORMER WITH A MANAGER OR AGENT <br />CITY CLERK <br />DATE; <br />AGREEMENT WITH MALO BAND, LLC TO PROVIDE A <br />Gs 0LIFE PERFORMANCE AT CITY OF SANTA ANA'S 2023 <br />(M.LXal)* CHICANO HERITAGE FESTIVAL <br />THIS AGREEMENT is made and entered into this 30 day of June , 2023, by and <br />�e.3 between MALO BAND LLC ("Contractor"), a California limited liability company f/s/o <br />Malo ("Artist"), and the City of Santa Ana, a charter city and municipal corporation <br />s— organized and existing under the Constitution and laws of the State of California ("City"). <br />c�a <br />RECITALS <br />A. The City desires to retain artists to provide live performances at the City's Chicano <br />Heritage Festival, <br />B. Contractor represents that Contractor is able and willing to provide such services to <br />the City. <br />C. In undertaking the performance of this Agreement, Contractor represents that it is <br />knowledgeable in its field and that any services performed by Contractor under this <br />Agreement will be performed in compliance with such standards as may reasonably <br />be expected. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions hereinafter set forth, the parties agree as follows: <br />1. SCOPE OF SERVICES <br />a. Contractor shall provide a performance by Artist for the City's Chicano Heritage <br />Festival on August 27, 2023 between 11a.m. — 7p.m. at El Salvador Park (1825 W <br />Civic Center Drive, Santa Ana, CA 92703). <br />b. Artist shall provide a 75 minute live performance to be coordinated with <br />event staff. <br />Contractor's Initials: MAD <br />C. Contractor must provide song list of family friendly, clean edit songs with lyrics <br />to be approved by the City of Santa Ana prior to performance. <br />2. COMPENSATION <br />a. City agrees to pay, and Contractor agrees to accept as total payment for its services <br />for City, including all travel expenses and performance by Artist, the rates and <br />charges identified in Exhibit A. The total amount to be expended under this <br />Agreement shall not exceed $ 11,500.00 . <br />Page 1 of 9 <br />
