Public Works Agency <br />https://www.santa-ana.org/pw <br />Item # 23 <br />City of Santa Ana <br />20 Civic Center Plaza, Santa Ana, CA 92701 <br />Staff Report <br />July 6, 2021 <br />TOPIC: Relocation of Public Utility and Emergency Vehicle Access Easements <br />AGENDA TITLE <br />Authorize Relocation of Public Utility Easements and Emergency Vehicle Access <br />Easements within 2590 South Redhill Avenue, and 1901, 1951 and 2001 East Dyer Road <br />(Applicants and Owners: PR/Broadstone Heritage I LLC, PR/Broadstone Heritage II LLC, <br />PR/Broadstone Heritage III LLC, and LD Acquisition Company 19 LLC) (No Fiscal Impact) <br />RECOMMENDED ACTION <br />Authorize the City Manager to execute quitclaim deeds relinquishing the City's interest in <br />public utilities easements and emergency vehicle access easements at 2590 South <br />Redhill Avenue, and 1901, 1951 and 2001 East Dyer Road to PR/Broadstone Heritage I <br />LLC, PR/Broadstone Heritage II LLC, PR/Broadstone Heritage I I I LLC, and LD Acquisition <br />Company 19 LLC, Delaware limited liability companies, in exchange for replacement <br />public utilities easement and emergency vehicle access easements. <br />DISCUSSION <br />Heritage Village OC, LLC is in the process of completing the construction of a mixed -use <br />development consisting of 1,400 residential units and 18,000 square feet of commercial <br />space at 2001 East Dyer Road. On February 2, 2016, the City Council approved a <br />General Plan amendment, development agreement, and tentative tract map along with <br />other entitlements to allow the project. The final tract map was prepared by the developer <br />and recorded with the County of Orange on August 19, 2016. The developer dedicated a <br />public utilities easement and an emergency vehicle access easement with the recordation <br />of the tract map (Exhibit 1). <br />After construction of the buildings and associated improvements within the development, <br />the developer discovered that portions of the easements conflict with the buildings. To <br />remove the conflicts, the developer has requested the City quitclaim the easements in <br />their entirety, and, in exchange, will grant replacement easements (Exhibit 2). Generally, <br />easements provide access or right of entry for specified purposes. In this case, <br />easements were granted to the City in order for the City to access private property to <br />maintain public utilities within the development and access the site in case of <br />emergencies. <br />
