<br />THIS TRANSACTION IS EXEMPT FROM CALIFORNIA DOCUMENTARY TRANSFER TAX
<br />PURSUANT TO SECTION 11922 OF THE CALIFORNIA REVENUE AND TAXATION CODE,
<br />PLATFORM AND TRACTION POWER SUBSTATION EASEMENT
<br />FOR 'VALUABLE CONSIDERATION, receipt and sufficiency of which is hereby
<br />acknowledged, the CITY OF SANTA ANA, a charter city and municipal corporation organized and
<br />existing under the Constitution and laws of the State of California, ("Grantor") hereby grants to the
<br />ORANGE COUNTY TRANSPORTATION AUTHORITY, A Public Entity ("Grantee"), an
<br />exclusive perpetual platform and traction power substation easement which allows Grantee and
<br />its employees, agents, representatives, contractors, successors and assigns the right to use the
<br />described property for the construction, operations, maintenance, and all related purposes, of the
<br />OC Streetcar System, in, on, over, under and across that certain real property situated in the City
<br />of Santa'Ana, County of Orange, State of California, which is described in Exhibit "A" and
<br />depicted on Exhibit "B", both of which are attached hereto and made a part hereof.
<br />Rights, Limitations of Use and Occupancy of Easements; and facilities to be constructed:
<br />• OCTA shall provide the City a minimum of thirty (30)-days written notice as to when
<br />construction will commence.
<br />• The OC Streetcar controlled work access zone is defined as the area extending four (4) feet
<br />beyond the farthest rail, any portion of a streetcar stop within ten (10) feet of a traction
<br />power substation unit and ten (10) feet from the overhead contact system (OCS).
<br />• No permanent improvements, including, but not limited to parking structures, walls, etc.
<br />shall be constructed by City on, over; below or above Parcel I Easement area, except for
<br />driveway purposes.
<br />• No permanent improvements, including, but not limited to parking structures, walls, etc,
<br />shall be constructed by City on, over, below or above Parcel 2 Easement area.
<br />• The facilities to be constructed an, over, below or above Parcel 1 Easement area are those
<br />elements included in the construction documents reviewed and approved by the City.
<br />• OCTA shall maintain all facilities within Parcel 1 Easement area with the exception of
<br />o Curb and gutter north of OCTA's traction power substation
<br />o Driveway pavement north end of TPSS area
<br />• The facilities to be constructed on, over below or above Parcel 2 Easement area are those
<br />elements included in the construction documents reviewed and approved by the City.
