Santa Ana 2020 Water Shortage Contingency Plan <br />3-14 <br />3.6 Compliance and Enforcement <br />Per the Water Code Section 10632 (a)(6), the City has defined customer compliance, enforcement, appeal, and <br />exemption procedures for triggered shortage response actions. Procedures to ensure customer compliance are <br />described in Section 3.5 Communication Protocols and customer enforcement, appeal, and exemption procedures <br />as defined in the existing Santa Ana Municipal Code Chapter 39 Article VI Water Shortage Contingency Plan <br />(Appendix B). The City intends to update any enforcement procedures in a subsequently adopted ordinance which <br />will supersede the existing ordinance. <br />3.7 Legal Authorities <br />Per Water Code Section 10632 (a)(7)(A), the City has provided a description of the legal authorities that empower <br />the City to implement and enforce its shortage response in Water Shortage Response Ordinance (Appendix B). <br />Per Water Code Section 10632 (a)(7) (B), the City shall declare a water shortage emergency condition to prevail <br />within the area served by such wholesaler whenever it finds and determines that the ordinary demands and <br />requirements of water consumers cannot be satisfied without depleting the water supply of the distributor to the <br />extent that there would be insufficient water for human consumption, sanitation, and fire protection. <br />Per Water Code Section 10632 (a)(7)(C), the City shall coordinate with any agency or county within which it <br />provides water supply services for the possible proclamation of a local emergency under California Government <br />Code, California Emergency Services Act (Article 2, Section 8558). This description must include potential reductions in <br />revenue and increased expenses associated with implementation of the shortage response actions. This should <br />be coupled with an identification of the anticipated mitigation actions needed to address these financial impacts. <br />During a catastrophic interruption of water supplies, prolonged drought, or water shortage of any kind, the City will <br />experience a reduction in revenue due to reduced water sales.
